Jakarta (ANTARA) - Legal practitioner Mohamad Ali Nurdin believes the\nnew Criminal Code (KUHP) and Criminal Procedure Code (KUHAP) will\noptimise legal assistance.<\/p>\n
He said the KUHAP contains eleven special privileges for advocates,\nnamely assistance from the outset, free communication, regular visits,\naccess to examination reports (BAP), the provision of legal advice, the\nactive filing of objections, protection of clients from intimidation,\nbringing in experts, access to interrogation recordings, expanded\npre-trial proceedings, and the strengthening of restorative justice.<\/p>\n
\u201cWith these various privileges, the legal assistance provided by\nadvocates will certainly be even more effective,\u201d Ali said in a\nstatement issued in Jakarta on Tuesday.<\/p>\n
He therefore believes the enactment of the new KUHP and KUHAP not\nonly proves the nation\u2019s independence in being able to produce its own\ncriminal law, but also drives the work of law enforcers, including\nadvocates.<\/p>\n
He said the issuance of the new KUHP and KUHAP has brought about a\nparadigm shift in law, from one that tended towards revenge to\nrestorative justice.<\/p>\n
In addition, he continued, the issuance of the two regulations\nprovides alternative punishments, particularly for minor offences, in\nthe form of community service and supervision, and opens the door to\nmediation for certain criminal matters.<\/p>\n
Another point, according to the head of the Bandung branch of the\nIndonesian Advocates Association (Peradi), is that the two new\nregulations also strengthen human rights, including fulfilling victims\u2019\nright to restitution, providing protection for suspects (due process of\nlaw), and strict oversight.<\/p>\n
Equally important, he added, the two regulations also provide\nnational legal certainty by replacing Dutch colonial law (Wetboek van\nStrafrecht) and upholding substantive justice.<\/p>\n
Furthermore, he hopes that socialisation of the new KUHP and KUHAP\nwill continue so that comprehensive understanding is achieved, not only\namong law enforcers but also among the public.<\/p>\n
Ali said he has been actively involved in socialising the new KUHP\nand KUHAP together with Peradi\u2019s National Leadership Council (DPN),\nengaging academics, law enforcers, and the community.<\/p>\n
