Legal decision on Indian School blasted<\/p>\n
JAKARTA (JP): The Supreme Court has been criticized for its
\ndecision to exonerate and reinstate the former principal of the
\nGandhi Memorial School, V. Ram, also known as Ram Gulumal, who
\nwas convicted of fraud last year.<\/p>\n
Lawyers for the Gandhi Seva Loka association, formally known
\nas the Bombay Merchants' Association, said that the decision
\ninvolved \"an obvious error\".<\/p>\n
The association's lawyer, Amir Syamsuddin of Amir Syamsuddin
\nand Partners, said yesterday that the law firm had sent a letter
\nto the Supreme Court asking for directives to prevent any
\nnegative effects of the decision on their client.<\/p>\n
\"We sent the letter to the Supreme Court today,\" Amir
\nSyamsuddin said.<\/p>\n
According to Amir, the Supreme Court decision erroneously
\nassumed Gulumal to be an Indonesian national.<\/p>\n
\"Gulumal is an Indian national and any mistake as to
\nnationality is very basic to a legal decision,\" said Amir,
\narguing that the mistake rendered the entire decision null and
\nvoid.<\/p>\n
Amir said that the Supreme Court had said in its judgment that
\nit upheld Gulumal's appeal in relation to his conviction for
\nmisappropriating school funds. This too, he said, was an obvious
\nmistake.<\/p>\n
\"He never appealed (in relation to misappropriation of school
\nfunds) since he was acquitted of that charge by the Central
\nJakarta District Court,\" Amir said.<\/p>\n
Amir said the Supreme Court decision was disappointing and
\ndisturbing to Indonesian citizens of Indian origin.<\/p>\n
\"On the basis of the Supreme Court's decision, Gulumal could
\ntake over the schools and the assets, which actually belong to
\nthe Indonesian citizens of Indian origin here,\" said Amir.<\/p>\n
Last week the Supreme Court ordered the reinstatement of Ram
\nGulumal as principal of the Gandhi Memorial School. Gulumal was
\nconvicted last year of fraud and sentenced to a term of
\nimprisonment. The charges were initiated by the Gandhi Seva Loka,
