Jakarta \u2013 Residents of Kalideres, West Jakarta, are pressing the West\nJakarta City Administration to respond to a summons for a court hearing\nat the State Administrative Court (PTUN) Jakarta concerning a lawsuit\nagainst the Swarga Abadi Housing and Crematorium project.<\/p>\n
This pressure emerged after the first hearing of the residents\u2019\nlawsuit was postponed because the defendant\u2014the West Jakarta City\nAdministration\u2014failed to appear without explanation during proceedings\nheld on Wednesday, 11 March 2026.<\/p>\n
Budiman Tandiono, coordinator of residents from Citra Garden 2,\nexpressed disappointment at the absence of a representative from the\nWest Jakarta Administrator in the hearing.<\/p>\n
\u201cOur hope going forward is that during the preparatory examination,\nthe defendant will appear in court, and we all hope the defendant will\npromptly revoke the building permit (PBG) of Yayasan Rumah Swarga Abadi\nso that the crematorium construction can be completely halted,\u201d Budiman\nsaid when contacted by Kompas.com on Wednesday.<\/p>\n
Budiman explained that the absence of the defendant, whether directly\nor through legal representatives, led the bench of judges to reschedule\nthe hearing and send a new official summons.<\/p>\n
\u201cToday the defendant from the mayor\u2019s office did not appear without\nclear reason, neither the defendant directly nor their legal\nrepresentative. Therefore, a new summons will be issued to the\ndefendant,\u201d he stated.<\/p>\n
According to Budiman, today\u2019s hearing should still have been at the\ninitial stage of the court proceedings, namely the preparatory\nexamination which includes examination of case files and administrative\ndocumentation from the plaintiff.<\/p>\n
However, the bench of judges also provided several administrative\nevaluation notes to the residents to complete documents, such as power\nof attorney and lawsuit documents. As a result, the hearing was\npostponed until the end of the month.<\/p>\n
Regarding the defendant\u2019s failure to appear, Kompas.com attempted to\ncontact West Jakarta Administrator Iin Mutmainnah as well as the head of\nthe Sub-Service for Public Works, Spatial Planning, and Land (CKTRP) of\nWest Jakarta, Lucia Purbarini. However, until this report was published,\nthere was no response or official statement from the West Jakarta City\nAdministration.<\/p>\n
Previously, residents from four Rukun Warga (neighbourhood\nassociations) in Kalideres and Pegadungan officially filed a lawsuit\nwith PTUN Jakarta concerning the housing and crematorium project.<\/p>\n
The lawsuit, case number 83\/G\/2026\/PTUN JKT, was registered on\nTuesday, 3 March 2026 and targeted the West Jakarta leadership as the\nentity that issued the Building Permit (PBG) for the project.<\/p>\n
\u201cThe defendant is the West Jakarta Administrator represented by the\nhead of the Capital Investment Management Unit and One-Stop Integrated\nService (PM-PTSP) of West Jakarta City,\u201d Budiman explained.<\/p>\n
The subject matter of the lawsuit is the building permit held by the\ndeveloper, which according to residents was issued despite the project\nlacking environmental approval. Additionally, the construction site is\nlocated in the middle of a residential area.<\/p>\n
\u201cYes, the lawsuit concerns the building permit.
