        "content": "<p>Legal Aid Institute (LBH) Surabaya is preparing a series of legal\nmeasures to assist activist Muhammad Ainun Komarullah, known as Komar,\nfrom Bandung, who was arrested by Surabaya Metropolitan Police\n(Polrestabes Surabaya) on the very day of his release from\ndetention.<\/p>\n<p>Komar has also been named as a suspect by Polrestabes Surabaya for\ncharges similar to those that resulted in his imprisonment at Rutan\nKebonwaru in Bandung.<\/p>\n<p>LBH Surabaya Director Habibus Shalihin stated that his organisation\nis currently focused on conducting an assessment of Komar\u2019s condition\nand the details of his case.<\/p>\n<p>This effort was undertaken immediately after the team received\ninformation regarding the unclear detention status that has left Komar\u2019s\nfamily confused.<\/p>\n<p>\u201cWe are still conducting an assessment of Komar, who is our client.\nThat is why his parents do not yet fully understand the situation.\nWhether he is still with the police or with the prosecution,\u201d said\nHabibus when contacted by CNNIndonesia.com on Thursday (12 March).<\/p>\n<p>LBH Surabaya stated that its current priority is to meet Komar\ndirectly in order to discuss the detailed chronology of events and\ngather the necessary legal documents.<\/p>\n<p>He stated that this step is crucial because complete data regarding\nthe case charges brought by police have not been fully received by the\nlegal team.<\/p>\n<p>\u201cSo our first step today will be to meet with the person concerned\nand discuss further what measures can be taken. We will still try to\nreview the documents held by the person concerned,\u201d he said.<\/p>\n<p>Based on initial information, Komar is suspected of being ensnared in\na case relating to his postings on social media under the account <span class=\"citation\" data-cites=\"blackbloczone\">@blackbloczone<\/span>,\nsimilar to the matter he previously faced in Bandung.<\/p>\n<p>Komar was previously sentenced to six months imprisonment by Bandung\nDistrict Court on 12 February 2026. He was found guilty of managing the\nInstagram account <span class=\"citation\" data-cites=\"blackbloczone\">@blackbloczone<\/span>, which was deemed to\nhave incited violence during the August 2025 demonstration disturbances\nat the West Java Regional House of Representatives complex.<\/p>\n<p>After completing his prison term, Komar was scheduled to be released\non Monday (9 March). However, Surabaya Metropolitan Police officers were\nwaiting at the gate of Rutan Kebon Waru with an arrest warrant.<\/p>\n<p>The principle of ne bis in idem<\/p>\n<p>Polrestabes Surabaya cited Komar\u2019s arrest as resulting from postings\non the social media account he manages, which had an impact on\ndisturbances in the area around the Grahadi State Building in Surabaya\nin August 2025.<\/p>\n<p>For this reason, Habibus stated that LBH Surabaya suspects there are\nindications of law enforcement officials committing negligence or\nviolations of applicable legal regulations, particularly regarding\nrepeated prosecution for identical digital content.<\/p>\n<p>He considered Komar\u2019s arrest as a violation of the ne bis in idem\nprinciple, which remains applicable as set out in Law No.\u00a01 of 2023\nconcerning the New Criminal Code.<\/p>\n<p>\u201cIn Komar\u2019s case, there are actually indications that law enforcement\nofficials have been negligent regarding several regulations, one of\nwhich concerns the principle that one matter cannot be tried multiple\ntimes, which is called ne bis in idem,\u201d said Habibus.<\/p>\n<p>Habibus stated that LBH Surabaya is open to all options for legal\nassistance, both litigation in court proceedings and non-litigation\nmeasures outside court.<\/p>\n<p>\u201cBecause we are discussing these efforts with the person concerned.\nThese can later be communicated to the public, whether in the form of\npreterm judicial review or taking reporting measures outside court, for\nexample to the National Human Rights Commission or Commission III of the\nHouse of Representatives,\u201d he said.<\/p>\n<p>Separately, Surabaya Metropolitan Police\u2019s Head of Criminal\nInvestigation AKBP Edy Herwiyanto previously confirmed the arrest. He\nexplained that Komar\u2019s case status in Surabaya has reached the P21 stage\nor completion stage. Therefore, after being handed over to prosecutors,\nKomar will soon face trial.<\/p>\n<p>\u201cThat is correct and the suspect has been handed over to the\nprosecution because the case has reached P21 status. As of Tuesday, 10\nMarch 2026,\u201d said Edy when contacted by CNNIndonesia.com on Wednesday\n(11 March).<\/p>\n<p>Edy stated that Komar was arrested because of postings on the social\nmedia account he manages, which had an impact on disturbances in the\narea around the Grahadi State Building in Surabaya in August 2025.<\/p>\n<p>\u201cThe case involves incitement using the <span class=\"citation\" data-cites=\"blackblokzone\">@blackblokzone<\/span> account which resulted\nin disturbances at Grahadi,\u201d he said.<\/p>\n<p>Surabaya Metropolitan Police Public Relations Chief AKP Hadi Ismanto\ndetailed the charges Komar faces relating to incitement and the spread\nof false information.<\/p>\n<p>\u201cArticles 45A paragraph (2) and paragraph (3) in conjunction with\nArticle 28 paragraph (2) and (3) of Law of the Republic of Indonesia\nNumber 1 of 2024 concerning the second amendment to Law Number 11 of\n2008 concerning Information and Electronic Transactions and\/or Article\n187 of the Criminal Code and\/or Article 363 of the Criminal Code and\/or\nArticle 170 of the Criminal Code and\/or Article 160 of the Criminal Code\nand\/or Article 406 of the Criminal Code and\/or Article 212 of the\nCriminal Code in conjunction with Article 55 of the Criminal Code in\nconjunction with Article 56 of the Criminal Code,\u201d said Hadi.<\/p>",
