        "content": "<p>Lembaga Bantuan Hukum (LBH) Jakarta condemned the actions of a TNI\nmember captured on video assaulting an online taxi driver on Jalan Raya\nPuspitek, Cisauk, South Tangerang. LBH Jakarta urged that the case be\nbrought to civilian court, not military justice. \u2018Drag the perpetrator\nto civilian court, reject impunity of military justice,\u2019 said LBH\nJakarta Director Fadhil Alfathan in a written statement on Wednesday 4\nMarch. Fadhil said handling cases like this through military courts will\nonly add to the long list of serious failures of the legal system and\nshow the deeply rooted culture of impunity within the TNI. So far, he\nsaid, military courts have proven unable to deliver real justice for\ncivilian victims. Many cases of violence by TNI members end without\nproper punishment, or the verdicts are far lighter than those in\ncivilian courts, thereby encouraging repeated violence. \u2018We view the\nproblem of violence by TNI members not merely as an individual issue,\nbut as a reflection of institutional failure and the entrenchment of a\nculture of violence within the military,\u2019 Fadhil said. He said this\nculture grows and is rooted due to structural and cultural factors. He\nstressed that acts of violence by TNI against civilians are criminal\nacts that must be accounted for under applicable law. Under Law No.\u00a01 of\n2023 on the Criminal Code (KUHP), every perpetrator of a criminal act\nmust be prosecuted and processed under the law without exception,\nincluding military personnel. In this case, the acts of the TNI member\ncan be classified under several types of crime. First, assault as\ndefined in Article 466 KUHP, due to actions of hitting, threatening, and\nphysically intimidating the victim. Second, extortion with violence\nunder Article 482 KUHP, as the victim experienced pressure and threats\nrestricting their freedom and was asked to pay a sum of money. Third,\nhostage-taking as provided for in Article 451 KUHP, as the victim was\nforcibly held and bound with threats of weapon. Fadhil said this\nclassification shows the act not only violates ethical norms and\ninternal military discipline but also criminal law that clearly\nregulates accountability for perpetrators of violence, including TNI\nmembers. \u2018Therefore, the state has an obligation to follow up legally to\nensure justice for the victim and uphold the supremacy of law without\ndiscrimination,\u2019 he said. Meanwhile, the Indonesian Army (TNI AD) has\nsecured a soldier suspected of making threats and assaulting the online\ntaxi driver in South Tangerang. In circulating video, the soldier\npointed a pistol-like object at the driver. Head of Public Information\nService of the Army (Kadispenad) Brig Gen Donny Pramono said Denpom\nJaya\/1 Tangerang immediately coordinated with the South Tangerang Police\nand related units. The result is that, on Monday night (2 March), the\nsoldier in question has been secured and is currently undergoing\nexamination at Madenpom Jaya\/1 Tangerang. \u2018The soldier involved has been\nsecured and is being examined by Denpom Jaya\/1 Tangerang.
