Lawyers say charges absurd<\/p>\n
BOGOR (JP): The defense lawyers for two men charged with being
\naccessories to robbery and murder on the Jagorawi toll road said
\nhere yesterday the indictments were unclear and should be
\ndropped.<\/p>\n
In the defendants' separate trials, their lawyers Almuzfar,
\nMansjur Abubakar and Castrio Pandji Indra told the courts their
\nclients, Erling Doly Wijaya and Heri Faisal, had not directly
\ncommitted the robbery or murdered the driver.<\/p>\n
The charges say that Erling, alias Mikel or Handoko, watched
\nthe robbery from his Mercedes, while Heri, alias Hendrik, climbed
\nout of a Kijang and smashed in the windshield of the victim's
\nsedan with a sickle.<\/p>\n
Zaenudin Lesmana, a private company employee, was shot and
\nkilled during the robbery and Rp 312 million was stolen from the
\ntrunk of his car.<\/p>\n
In previous hearings, the prosecutors said that Zaenudin was
\nshot by a friend of the defendants, Budiarto. But it was not
\nclear who stole the money from the Hyundai sedan.<\/p>\n
Budiarto and two accomplices, Iskandar and Iedfil Jaya Anwar
\nare still at large. The prosecutors said Iedfil planned the fatal
\nrobbery.<\/p>\n
They said the defendants had violated Article 339 and Article
\n365 Paragraph 4 of the Criminal Code. These relate to
\npremeditated murder and violators may face the death penalty.<\/p>\n
The lawyers said yesterday that these charges should not have
\nbeen laid against their clients, judging from their minor roles
\nin the crime.<\/p>\n
The trials are apparently still attractive to the public. The
\ncourt was packed. Zaenudin's daughter, Visca, was among the
\nspectators.<\/p>\n
