Law on mining challenged<\/p>\n
JAKARTA: As many as 90 non governmental organizations (NGOs)
\nand 80 individuals have challenged Law No. 19\/2004, which
\nstrengthens a government regulation in lieu of law approving open
\npit mining in protected forests.<\/p>\n
Dede Nurdin Sadat, one of the lawyers representing the
\nplaintiffs, said that the law unconstitutional because its
\nclearly states that the law was enacted to support the interests
\nof investors, rather than the Indonesian people.<\/p>\n
He told the Constitutional Court on Wednesday that the
\nConstitution guarantees human rights, including the rights of
\npeople to live in a preserved environment, while mining
\noperations are always associated with environmental destruction.<\/p>\n
The government regulation in lieu of law, which was issued
\nearlier last year, allows 13 mining firms to resume operations in
\nprotected forests.<\/p>\n
The firms were part of a large group of mining companies
\nforced to suspend operations following the enactment of a new
\nforestry law in 1999 that banned open-pit mining in protected
