        "content": "<p>Jakarta (ANTARA) - Minister of Manpower (Menaker) Yassierli has\nwarned of sanctions for companies that fail to comply with regulations\non the provision of religious holiday allowances (THR) to workers.<\/p>\n<p>\u201cAs a rule-of-law state, all companies are obliged to adhere to\napplicable provisions and ensure that workers\u2019 rights are fulfilled\nproperly,\u201d said Menaker Yassierli in a statement in Jakarta on\nWednesday.<\/p>\n<p>He emphasised that THR is a normative right of workers\/labourers that\nmust be paid in full and cannot be deducted for any reason, including\ndue to absenteeism or the company\u2019s economic condition.<\/p>\n<p>\u201cTHR must not be deducted. There is a misunderstanding when THR is\nlinked to absenteeism, and that is not permissible,\u201d said the\nMinister.<\/p>\n<p>He added that if there is a delay in payment, employers will be fined\n5 percent of the total THR that must be paid.<\/p>\n<p>That fine does not eliminate the obligation to pay THR and is used\nfor the welfare of workers\/labourers in accordance with applicable\nprovisions.<\/p>\n<p>According to him, every company is obliged to comply with statutory\nregulations because Indonesia is a rule-of-law state that places the\nprotection of workers\u2019 rights as an obligation that must be\nfulfilled.<\/p>\n<p>This week, Minister Yassierli conducted a surprise inspection (sidak)\nat negligent companies, one of which was in Semarang Regency, Central\nJava.<\/p>\n<p>This followed reports that workers\u2019 THR at that company was not paid\nin full.<\/p>\n<p>He urged the company to immediately settle the remaining unpaid\nTHR.<\/p>\n<p>From the meeting with management, the company employing around 951\nworkers expressed its commitment to complete the payments by 2 April\n2026 at the latest.<\/p>\n<p>The case stemmed from a complaint received by the Religious THR\nCommand Post 2026 of the Ministry of Manpower (Kemnaker) on 16 March\n2026. In the report, the company was complained about for not having\npaid THR despite having passed the payment deadline of seven days before\nthe religious holiday.<\/p>\n<p>After follow-up by labour inspectors, the company made a payment on\n18 March 2026. However, a follow-up report emerged that the payment was\nnot made in full.<\/p>\n<p>During the sidak, the Minister obtained information that the THR\npayment not in accordance with the provisions was based on the company\u2019s\npoor economic condition, as well as a misunderstanding linking THR to\nworkers\u2019 attendance levels.<\/p>\n<p>Yassierli asserted that such reasons are unjustifiable, and cases\nlike this must not recur, either at that company or others.<\/p>\n<p>\u201cThings like this must not happen again. I warn that similar\npractices should not occur at any company,\u201d said the Minister.<\/p>\n<p>\u201cThis year, we will continue to monitor closely to ensure all\nworkers\u2019 rights are paid in accordance with applicable regulations,\u201d he\nadded.<\/p>",
