        "content": "<p>Jakarta (ANTARA) - The Corruption Eradication Commission (KPK),\nthrough its Legal Bureau, will study the implementation of the\nConstitutional Court\u2019s decision regarding the stipulation that only the\nFinancial Audit Board (BPK) is authorised to calculate state financial\nlosses in handling cases at the anti-corruption agency.<\/p>\n<p>KPK Spokesperson Budi Prasetyo stated that this step is intended to\nensure that the legal processes for alleged corruption offences\nconducted by the KPK do not open formal or substantive loopholes.<\/p>\n<p>\u201cThis is also to ensure that the process of calculating state\nfinancial losses in the series of case handling can run effectively,\u201d\nBudi told reporters in Jakarta on Tuesday.<\/p>\n<p>He explained that the study of the Constitutional Court\u2019s decision in\nhandling cases at the KPK, particularly for alleged corruption offences\nrelated to state financial losses as regulated in Articles 603 and 604\nof the National Criminal Code (KUHP), will be conducted.<\/p>\n<p>Budi stated that the study also includes ways to adjust and optimise\nthe functions of Forensic Accounting (AF) at the KPK, which previously\nhad the authority and function in calculating state financial\nlosses.<\/p>\n<p>\u201cLikewise, coordination with the BPK going forward will continue to\nbe carried out,\u201d he said.<\/p>\n<p>Budi emphasised that his side respects and complies with the\nConstitutional Court\u2019s decision which examined Articles 603 and 604 of\nthe National Criminal Code.<\/p>\n<p>In Decision Number 28\/PUU-XXIV\/2026, the Court stated that the agency\nauthorised to calculate state financial losses is the BPK.<\/p>\n<p>The decision, which was read out in early February 2026, is based on\nthe constitutional mandate in the 1945 Constitution and Law Number 15 of\n2006 on the BPK.<\/p>\n<p>With this decision, state losses may no longer be based solely on\npotential or assumptions, but must be actual and proven through BPK\naudit results.<\/p>\n<p>Therefore, law enforcement agencies, such as the KPK and the\nProsecutor\u2019s Office, must coordinate with the BPK for calculating state\nlosses to adjust the legal processes in corruption cases.<\/p>",
