        "content": "<p>Banten, Kompas.com \u2013 The Corruption Eradication Commission (KPK) said\nthat the Audit Board of Indonesia (BPK) would not be able to handle\ncalculating state losses in corruption cases involving all law\nenforcement agencies due to limited human resources.<\/p>\n<p>This was said by KPK Deputy for Enforcement and Execution Asep Guntur\nRahayu while responding to the MK ruling on how state losses are\ncalculated by the BPK.<\/p>\n<p>Asep said the limitation in manpower was confirmed after discussions\nwith BPK.<\/p>\n<p>\u2018According to our colleagues at BPK, to cover all state-loss\ncalculations submitted by all law enforcement agencies, including the\nPolice, the Attorney General\u2019s Office, and the KPK, there would be a\nvery long queue, and it would be impossible, given the human resources\navailable at BPK,\u2019 he said at a media briefing in Anyer, Banten, on\nWednesday (20 May 2026).<\/p>\n<p>He said one option is for BPK to provide guidance and methodologies\nrelated to calculating state losses and to certify auditors who are\nbased elsewhere.<\/p>\n<p>\u2018For example, we have forensic accountants. They would be certified\nto ensure alignment with the calculation methodology and other aspects,\nso that the auditors can perform the calculations,\u2019 he added.<\/p>\n<p>He stressed that cases of suspected corruption calculated by the KPK\nthrough the Financial and Development Supervisory Agency (BPKP) would\ncontinue.<\/p>\n<p>\u2018We are also awaiting this study from the Legal Bureau, and we will\nfollow it. But fundamentally, we must not hinder the law enforcement\nprocess,\u2019 he said.<\/p>\n<p>The assertion is contained in MK Decision No.\u00a028\/PUU-XXIV\/2026,\nissued on Monday, 9 February 2026, as reported by Kompas.com from the\nofficial mkri.id site.<\/p>\n<p>In its legal reasoning, the MK stated that the concept of state\nlosses adopted in Indonesia is the loss within the meaning of a material\noffence, meaning that a wrongdoing can only be said to harm state\nfinances if there is real or actual loss.<\/p>\n<p>In other words, the state loss must have actually occurred and its\namount can be calculated based on findings of the competent agencies or\ninstitutions.<\/p>\n<p>\u2018The concept of state losses adopted by Indonesia is the concept of\nlosses in the sense of a material offence, i.e., a wrongdoing can be\nsaid to harm state finances only if there is real or actual loss,\u2019 the\nMK\u2019s legal reasoning states.<\/p>",
