The government has prohibited operators from voiding or eliminating\nunused internet quota belonging to users who have already paid for it.\nThe ban is set out in Circular Letter of the Minister of Communication\nand Digital Affairs Number 4 of 2026 concerning the Obligation to\nProvide Service Options and Protection of Remaining Quota, issued on 28\nAugust 2026.<\/p>\n
The circular also prohibits additional charges for customers who wish\nto retain or use their remaining quota.<\/p>\n
Minister of Communication and Digital Affairs Meutya Hafid said that\nremaining quota is the right of the customer and must be protected. The\nremaining quota must not be allowed to expire.<\/p>\n
\u201cQuota that has been paid for by the customer is the customer\u2019s\nright. Remaining quota must not simply be voided, and operators must not\nimpose additional charges to maintain that remaining quota,\u201d Meutya said\nin a statement quoted on Monday (31\/8\/2026).<\/p>\n
Meutya added that the policy will ensure customers receive fair\nbenefit from the services they have paid for.<\/p>\n
In addition, Komdigi requires operators to provide service options so\nthat customers can determine the mechanism that suits their needs. These\ninclude quota accumulation, no quota accumulation, extension of active\nperiod, transfer of benefits, compensation, refunds, or other forms of\nprotection that do not disadvantage the customer.<\/p>\n
\u201cPreviously, service options were largely determined by the operator.\nNow we are ensuring that customers have a choice. Customers have the\nright to choose services that suit their needs and usage patterns, not\nthe operator choosing for the customer,\u201d Meutya said.<\/p>\n
Operators are also required to educate and inform customers about\npricing, quota volume, validity period, usage segmentation, fair usage\nprovisions, service expiry date, and treatment of remaining quota.<\/p>\n
This information must be conveyed simply, clearly and in an easily\nunderstood manner so that customers can know their rights and the\noptions available to them.<\/p>\n
Komdigi has set a deadline of 28 September 2026 for operators to\nsubmit reports on fulfilment of obligations. In addition, periodic\nreports on progress in fulfilling obligations are required once a\nmonth.<\/p>\n
These reports form part of the mechanism for monitoring operator\ncompliance with the provisions on protection of remaining quota and\nfulfilment of service options for customers.<\/p>\n
This circular is a follow-up to Constitutional Court Decision Number\n23\/PUU-XXIII\/2025 dated 23 July 2026. At that time it was stated that\ncustomers may continue to use quota until it is exhausted without being\ncharged additional fees.<\/p>\n
\u201cIn real terms, quota that has not been fully used or enjoyed must\nremain protected as the property of telecommunications service users so\nthat it can be used until the quota is exhausted without being burdened\nwith additional fees or tariffs under the pretext of extending the\nactive period or for any other reason,\u201d explained Constitutional Court\njudge Adies Kadir.<\/p>\n
The Constitutional Court also emphasised guaranteeing protection for\nusers. This can take various forms, including a quota accumulation\n(rollover) feature or packages without rollover.<\/p>\n
