Kelapa Gading developer fails to meet obligations<\/p>\n

PT Summarecon Agung, the main property developer in Kelapa
\nGading, North Jakarta, has failed to give some 34.3 hectares of
\nland back to the city with social facilities, as part of its
\ncontractural obligation.<\/p>\n
City regulations state that once a company wins a contract
\nfrom the city to build, it must also develop 30 percent of the
\nland for social facilities, such as a park or a church and then
\nthat land is legally transferred back to the city administration.<\/p>\n
However, data from the City Asset Bureau dated March 4, 2003,
\nreleased during Thursday's hearing at the City Council's
\nCommission D for development affairs, states that the 34.3
\nhectares had been accumulated over the years after it was given
\ndevelopment projects between 1989 and 1997.<\/p>\n
The developer is now required to give the 34.3 hectares of
\npublic land back to the city after it developed housing projects
\non 96.9 hectares in two subdistricts of Kelapa Gading district:
\nPegangsaan Dua and Kelapa Gading Barat.<\/p>\n
Head of the Commission D Koeswadi Soesilohardjo urged the
\ncompany as the developer in the fastest growing area in the city,
\nto immediately fulfill its obligation.<\/p>\n
\"We demand that PT Summarecon Agung immediately hand over the
\nland as is required,\" Koeswadi told the press after meeting with
\nthe company's management.<\/p>\n
PT Summarecon president director Sunardi Rusli said that the
\ndata issued by the City Asset Bureau was not entirely accurate,
\nbut he could not elaborate. He said that parts of the land had
\nbeen handed over to the city administration.<\/p>\n
But he failed to show clear data about how obligation had been
\nfulfilled.<\/p>\n
Koeswadi stressed that PT Summarecon could not claim that it
\nhad fulfilled its obligation if it could not show an official
\ndocument.<\/p>\n
\"They can claim that they have handed over the land, but if
\nthere is no supporting document we cannot just believe them,\" he
\nadded.<\/p>\n
During the meeting, Sunardi also revealed that the city
\nadministration still owed PT Summarecon 4.7 hectares of land in
\nCilincing, North Jakarta, worth some Rp 53 billion rupiah.<\/p>\n
The city administration constructed buildings on the land for
\na city training center for job seekers.<\/p>\n
According to Sunardi, Gubernatorial Decree no. 7 issued in
\n1994 allowed PT Summarecon to provide the 4.7 hectares of land in
\nCilincing as part of the social facility\/public facility for PT
\nSummarecon's properties in Kelapa Gading.<\/p>\n
Kelapa Gading district, which was established in early 1990s,
\nis the fastest growing area in the city. The 1,633-hectare
\ndistrict is now crowded with shopping centers and housing.<\/p>\n
There are three subdistricts in Kelapa Gading district: Kelapa
\nGading Barat, Kelapa Gading Timur and Pegangsaan Dua. Kelapa
\nGading district was formerly part of Koja district, but it became
\na separate district following the development of the area.<\/p>",
