Just law enforcement 'may negate corruption'<\/p>\n
JAKARTA (JP): A noted legal expert has stressed the need to
\npromote consistency in law enforcement, instead of legal reform,
\nin the effort to curb rampant abuses.<\/p>\n
Satjipto Rahardjo, a law professor at Diponegoro University in
\nSemarang, Central Java, said law enforcement was deteriorating
\ncompared to 10 years ago.<\/p>\n
\"There is a kind of divergence since the law enforcement has
\nyet to match what is expected and is not yet in line with the
\n1945 Constitution,\" he said in Semarang yesterday in response to
\nthe cries for reform from students nationwide.<\/p>\n
The Constitution contained the spirit of family, economic
\ndemocracy and rule by the people and, therefore, the authorities
\nshould have this familial and democratic spirit in enforcing the
\nlaw, he was quoted as saying by Antara news service.<\/p>\n
\"The Constitution gives more emphasis on the civil society
\nthan the legal system. In practice, this emphasis depends much on
\nauthorities having competence in enforcing the law, including the
\ngovernment, court, police, prosecutors, lawyers and judges.\"<\/p>\n
He said corruption, collusion and nepotism were anticipated in
\nthe Constitution, but they were rampant due to people's failings,
\nnot the law itself.<\/p>\n
Laws on corruption, subversion and the environment have been
\nmade, but corrupt practices and environmental violations were
\nstill rampant because authorities were inconsistent in enforcing
\nthe laws, he said.<\/p>\n
In a short-term program, he said, the law authorities should
\nlearn to faithfully and consistently enforce the law.<\/p>\n
\"We need no changes in the judicial system, court organization
\nor new laws. What should be done is see to that authorities
\nenforce the existing law consistently and in the spirit of the
\nconstitution.\"<\/p>\n
Meanwhile in Yogyakarta, sociologist Nasikun of Gadjah Mada
\nUniversity said failure to faithfully enforce the law in many
\npolitical aspects had produced a political system riddled with
\ncorruption, collusion and nepotism.<\/p>\n
\"The New Order's political system has no correction mechanism
\nto check the rampant power abuses conducted by (its) main
