Judicial Commission's task needs to be defined: Judge<\/p>\n

The work of the yet-to-be-established Judicial Commission should
\nbe clearly defined to avoid overlapping functions with the
\nSupreme Court, a judge said Wednesday.<\/p>\n
Supreme Court judge Marianna Sutadi said he hoped the Judicial
\nCommission would not interfere with the Supreme Court's task of
\nassessing judges and reconsidering their rulings.<\/p>\n
\"We support the establishment of a Judicial Commission as an
\nexternal supervisor, but its function should be different to that
\nof the Supreme Court,\" she said on the sidelines of a workshop
\nhere.<\/p>\n
Without such a distinction, the supervisory role would not be
\neffective due to the long decision-making process, she said.<\/p>\n
For example, the commission could inspect judges outside the
\ncourt or in their daily life whether or not the judges had
\nviolated laws, she said.<\/p>\n
The establishment of a Judicial Commission is obligatory under
\nthe amended 1945 Constitution.<\/p>\n
The commission would have the authority to recommend the
\nappointment of judges and supervise the conduct of all judges in
\nthe country.<\/p>\n
The establishment of the commission was approved amid concerns
\nthe Supreme Court would monopolize judicial power when the
\njustice ministry relinquished its power to manage courts in 2003.<\/p>\n
Many expect the new commission to create a better court
\nsystem.<\/p>\n
At present, the Ministry of Justice and Human Rights handles
\nadministrative and financial matters in the courts.<\/p>\n
Several parties have now drafted versions of the bill
\nregarding the commission before presenting it to the House of
\nRepresentatives.<\/p>\n
Justice Abdul Rahman Saleh agreed with Marianna.<\/p>\n
He said the authority of the Judicial Commission stipulated in
\nthe 1945 Constitution was too broad, and needed to be modified.<\/p>\n
Meanwhile, Chief Justice Bagir Manan said he expected the
\nJudicial Commission would help resolve various problems in the
\ncountry's courts.<\/p>\n
\"We're trying to solve problems in courts little by little.
\nDon't expect spontaneous results,\" he said.<\/p>\n
He said he had also put in place measures to create better
\nmechanisms in the court.<\/p>\n
For example, he said, he had sent letters to High Court judges
\nto restrict the number of cases being appealed to the Supreme
\nCourt.<\/p>\n
\"At present 500-600 cases are handled by the Supreme Court
\nannually,\" he said.<\/p>",
