Jakarta (ANTARA) - The panel of judges at the Military Court II-08 in\nJakarta firmly rejected all objections (exceptions) submitted by the\ndefendants and their legal advisors in the case of the alleged murder of\na bank branch manager in Jakarta.<\/p>\n
\u201cThe panel decides to reject the objections raised by the defendants\nand the defendants\u2019 legal advisors,\u201d said Chief Judge Colonel Chk Fredy\nFerdian Isnartanto during the reading of the interlocutory decision at\nthe Military Court II-08 in Cakung, East Jakarta, on Wednesday.<\/p>\n
In its ruling, the panel of judges stated that the objections raised\nwere unacceptable and lacked legal basis.<\/p>\n
The panel also confirmed that the Military Court II-08 in Jakarta has\nthe authority to try the case.<\/p>\n
Consequently, the trial process will proceed to the next stage.<\/p>\n
The costs of the case are temporarily suspended until the final\ndecision is issued.<\/p>\n
\u201cThe panel states that the Military Court II-08 in Jakarta is\nauthorised to try the case of the defendants, the examination of the\ncase will continue, and the costs of the case are suspended until the\nfinal decision,\u201d explained Fredy.<\/p>\n
In its legal considerations, the panel of judges thoroughly reviewed\nvarious points of the objections raised by the legal advisors.<\/p>\n
One key issue highlighted was the request to separate the case files\nof the defendants (splitting).<\/p>\n
The panel of judges opined that combining the case files remains\nrelevant and appropriate.<\/p>\n
This is because all the acts alleged against the defendants are\nconsidered to form a single chain of criminal events that occurred at\nthe same time.<\/p>\n
Although each defendant has a different role, the panel assessed that\nthese differences will be clearly revealed in the proof process during\nthe trial through the examination of witnesses.<\/p>\n
Furthermore, the panel emphasised that the authority to determine\nwhether cases are combined or separated lies entirely with the Military\nProsecutor as the composer of the indictment.<\/p>\n
In fact, combining the cases is seen as better reflecting the\nprinciples of swift, simple, and low-cost justice, while providing legal\ncertainty for all parties.<\/p>\n
Additionally, the panel of judges rejected the legal advisors\u2019\nargument that the Military Prosecutor\u2019s indictment was not carefully,\nclearly, and completely drafted.<\/p>\n
According to the panel, the indictment Number Sdak\/49\/K\/III\/2026\ndated 6 April 2026 has met the formal and material requirements.<\/p>\n
The indictment contains the identities of the defendants, a\ndescription of the events, and the charged articles clearly.<\/p>\n
Regarding the objection that there was an error in the application of\narticles to the third defendant or an alleged error in persona, the\npanel of judges deemed it inappropriate to examine this in the\nexceptions stage.<\/p>\n
The assessment of the accuracy of the articles and the roles of each\ndefendant will be proven in the main examination of the case during the\ntrial.<\/p>\n
\u201cThe indictment contains a careful, clear, and complete description,\nand is supported by sufficient preliminary evidence,\u201d stated Fredy.<\/p>\n
The panel of judges also addressed the legal advisors\u2019 objections\nregarding the designation of suspects and defendants, particularly for\nthe third defendant who was said to lack sufficient evidence.<\/p>\n
In its ruling, the panel stated that the involvement of the\ndefendants is supported by witness statements and meets the formal\nrequirements as outlined in the Military Prosecutor\u2019s indictment.<\/p>\n
The panel assessed that the roles of each defendant have been\nexplained in the indictment, while the technical details are contained\nin the Examination Record of Proceedings (BAP).<\/p>\n
Furthermore, the panel viewed that these objections enter the realm\nof the main case, which should be proven in the trial process, not in\nthe exceptions stage.<\/p>\n
For several other objections that essentially repeated the argument\nthat the indictment is unclear and incomplete, the panel of judges chose\nnot to reconsider them.<\/p>\n
This is because the substance of these objections is deemed the same\nas the points previously discussed.
