        "content": "<p>Former Constitutional Court (MK) Chief Justice and constitutional law\nexpert Jimly Asshiddiqie has proposed using the omnibus method to revise\nthe Electoral Law.<\/p>\n<p>He stated that there had previously been agreement to revise the\nElectoral Law through limited codification. He then proposed\ncomplementing this approach with a limited omnibus technique.<\/p>\n<p>\u201cBut alright, since limited codification has already been agreed\nupon, I propose that we also use the omnibus method with a limited\ntechnique,\u201d Jimly said during a working meeting with Commission II of\nthe House of Representatives on Tuesday, 10 March.<\/p>\n<p>According to him, there are 16 laws that need to be considered for\nintegration into the Electoral Law revision through the omnibus\nmethod.<\/p>\n<p>\u201cFriends, these 16 laws are what I believe need to be subject to the\nomnibus approach,\u201d he said.<\/p>\n<p>Jimly cited several laws that regulate regions with specific\ncharacteristics, such as Aceh and Jakarta.<\/p>\n<p>He noted that Aceh does not have a General Election Commission (KPU),\nbut rather an Independent Election Commission (KIP).<\/p>\n<p>Likewise, the electoral supervisory body is called Panwaslih, which\ndiffers from Panwaslu in other regions.<\/p>\n<p>\u201cWhen established, Panwaslih has five members. Panwaslu throughout\nIndonesia has three members, appointed at the national level. The two\nadditional members are selected from the local provincial legislature.\nLater, during implementation, there are disputes over budgets. So,\nplease correct this in this law,\u201d he said.<\/p>\n<p>In Jakarta, Jimly cited the example of electoral organising\ninstitutions that exist in cities and regencies despite there being no\nlocal elections.<\/p>\n<p>\u201cThe KPU exists in every city down to the Thousand Islands Regency.\nThe population is only a few thousand, yet there is a KPU there. What is\nthe point of having a KPU? Elections only happen once every five years.\nThere are no local elections. In that region, an ad hoc arrangement\nwould suffice. But the KPU and Bawaslu exist in every city. This is\nbecause the law on regional administrations and the law on elections do\nnot correct this,\u201d he said.<\/p>\n<p>He also addressed the Broadcasting Law. Jimly stated that there are\nno provisions in that law clearly and firmly establishing that broadcast\nairtime belongs to the public.<\/p>\n<p>\u201cTherefore, during election periods, all parties should have equal\nrights to obtain airtime for advertisements. It should not be the case\nthat the party whose chair general owns a television station has an\nadvertisement every five minutes, whilst other parties must pay. This\nneeds to be addressed in the broadcasting law with one additional\narticle,\u201d Jimly said.<\/p>\n<p>\u201cIntroducing what I call CPR, not CSR\u2014corporate political\nresponsibility\u2014because whilst shareholders are private, television\nfrequencies belong to the public. Therefore, we need to regulate this,\u201d\nhe added.<\/p>",
