        "content": "<p>Jakarta Remains Capital: OIKN Response to Court Ruling<\/p>\n<p>Reporter<\/p>\n<p>May 14, 2026 | 05:17 pm<\/p>\n<p>TEMPO.CO, Jakarta - The Nusantara Capital Authority (OIKN) has\nexpressed its respect for the Constitutional Court\u2019s decision-making\nprocess, describing it as an essential part of Indonesia\u2019s democratic\nmechanism and the rule of law.<\/p>\n<p>OIKN Spokesperson Troy Pantouw stated that the Court\u2019s ruling in case\nnumber 71\/PUU-XXIV\/2026, which clarifies that the national capital\nremains in Jakarta rather than Nusantara or IKN, is not an issue. \u201cWe\nhave no issue,\u201d Troy said when reached via WhatsApp on Wednesday, May\n13, 2026.<\/p>\n<p>According to him, the a quo decision actually reinforces the legal\nframework for the relocation of the capital from Jakarta to Nusantara,\nwhich will take effect once the Presidential Decree is issued as\nmandated by law.<\/p>\n<p>Nevertheless, Troy added that the Court\u2019s decision has no impact on\nthe pace of construction in IKN. Development continues to move forward\naccording to the stages established by the government.<\/p>\n<p>He further noted that the construction of basic infrastructure,\ngovernment zones, business ecosystems, and public services is showing\nconsistent and positive progress.<\/p>\n<p>\u201cWe invite all parties to maintain optimism, stability, and public\ntrust in the development of IKN,\u201d he said.<\/p>\n<p>Previously, the Court rejected a petition for a constitutional review\nof Law Number 3 of 2022 concerning the National Capital (UU IKN). In its\nconsiderations, the Court examined the petitioner\u2019s arguments and\nevidence regarding the material test of Article 39, paragraph (1) of the\nlaw.<\/p>\n<p>The Court held that while Nusantara has been legally and politically\nestablished as the national capital, the formal relocation process is\nstill awaiting a presidential decision.<\/p>\n<p>Thus, within the bounds of reasonable judgment, as long as the\npresident has not issued a formal decree regarding the move from Jakarta\nto IKN, the capital remains in Jakarta.<\/p>\n<p>Constitutional judge Adies Kadir deemed the petitioner\u2019s argument\nregarding Article 2, paragraph (1) of Law Number 2 of 2024 inconsistent\nwith Article 39, paragraph (1) of the IKN Law.
