        "content": "<p>Jakarta Bay developers want official go-ahead for project<\/p>\n<p>JAKARTA (JP): Some developers joining the ongoing reclamation<br>\nproject, which covers 2,700 hectares in Jakarta Bay, asked<br>\nyesterday for legal assurance that the project will continue.<\/p>\n<p>A representative of PT Manggala Krida Yudha (MKY) said his<br>\ncompany had been encountering an overlap in the project's<br>\nsupervision since it joined the venture.<\/p>\n<p>\"Before the issuance of Presidential Decree No. 52\/1995, which<br>\nstates the supervision and control of the reclamation project is<br>\nin the hands of the city administration, an overlap emerged among<br>\nsome of the ministries involved in this project,\" an executive of<br>\nMKY, who asked for anonymity, told The Jakarta Post.<\/p>\n<p>\"But our intention is to make things work among all parties<br>\ninvolved. That is why we signed an agreement with both sides --<br>\nthe state-owned port management company, PT Pelindo II, as a<br>\nrepresentative of the Ministry of Transportation, and BP Pantura<br>\n(Jakarta Bay Supervision Board) for the municipality,\" he said.<\/p>\n<p>The city councilors have urged the Ministry of Transportation<br>\nto hand over the control and supervision of the project to the<br>\ncity administration to speed up construction.<\/p>\n<p>Based on the presidential decree, the municipality has the<br>\nlegal support of a \"superior law\" to run the project, the<br>\ncouncilors said.<\/p>\n<p>However, some developers have signed agreements with the<br>\nMinistry of Transportation, which oversees waters near the<br>\nTanjung Priok Port, through Pelindo II.<\/p>\n<p>\"We made a deal with Pelindo II before the presidential decree<br>\nwas issued,\" the executive said.<\/p>\n<p>\"Why? Because according to the existing rules jointly signed<br>\nby three ministries in 1972, the sea on which our project (Ancol<br>\nBaru) is developed, is part of the Ministry of Transportation's<br>\nauthority.\"<\/p>\n<p>MKY has been allowed to reclaim 500 hectares under the project<br>\nand will manage 375 hectares while its partner, Pelindo II, has<br>\ncontrol of the remaining 125 hectares.<\/p>\n<p>\"(The councilors) cannot just order us to cancel the agreement<br>\nwith Pelindo II,\" he said. \"Is everything canceled just because<br>\nthere is a higher law, without caring about what was done<br>\nearlier?<\/p>\n<p>\"We (the developers) need legal assurance because this problem<br>\nwill affect the reclamation project in the future,\" he said.<\/p>\n<p>MKY also signed a development agreement with BP Pantura last<br>\nmonth regarding its obligation to build social and public<br>\nfacilities within its 375-hectare plot.<\/p>\n<p>The MKY executive said BP Pantura was a new institution --<br>\nestablished in 1995 -- so it was having some difficulty adjusting<br>\nto the other related parties that have been involved in the<br>\nproject for longer.<\/p>\n<p>\"In fact, it is hard even to meet officials of BP Pantura, who<br>\nare mostly new and not as professional as, for instance,<br>\nofficials of Pelindo II, who have experience in managing the<br>\nJakarta Bay area.<\/p>\n<p>\"The board is practically left with nothing to do. Land use,<br>\nfor example, is managed by the National Land Agency (BPN), while<br>\nthe sea is managed by the Ministry of Transportation.<\/p>\n<p>\"So there should be clearer authority and consolidation,\" he<br>\nsaid. \"Don't just sacrifice the existing agreements because the<br>\nmunicipality wants to increase its authority.\"<\/p>\n<p>An executive of another developer, which reclaims a western<br>\npart of the bay, said yesterday that his company was also<br>\nencountering difficulties because of the overlapping.<\/p>\n<p>\"We're confused. Actually, who is in charge of what? We are<br>\njust businessmen who are trying to complete our project. I hope<br>\n(the ministry and the municipality) will settle this matter soon,<br>\nso we can continue the project,\" he said.<\/p>\n<p>He said the bay's reclamation was not a cheap project and<br>\nurged parties and institutions involved not to be arrogant.<\/p>\n<p>\"It needs good coordination among the parties to make the<br>\nproject work,\" he said.<\/p>\n<p>The developers are reportedly waiting for a final decision<br>\nfrom the government to settle the dispute.
