        "content": "<p>Intellectual property laws passed<\/p>\n<p>JAKARTA (JP): The government pledged yesterday that the<br>\namended laws on intellectual property rights approved by the<br>\nHouse of Representatives yesterday would boost technological<br>\ndevelopment, trade and investment in Indonesia.<\/p>\n<p>After two months of deliberations, the House approved the<br>\namended laws in a session presided by Deputy House Speaker<br>\nSoetedjo and attended by Minister of Justice Oetojo Oesman.<\/p>\n<p>Oetojo said, &quot;The laws will protect intellectual rights and<br>\nincrease innovation in technology, science and arts, and increase<br>\ntrade and investment in Indonesia.&quot;<\/p>\n<p>The amendments passed yesterday were on the 1987 law on<br>\ncopyright, the 1989 law on patents and the 1992 law on<br>\ntrademarks.<\/p>\n<p>Amendments were made so that the laws would match the<br>\nrequirements of the Agreement on Trade Related Aspects of<br>\nIntellectual Property Rights, Including Trade in Counterfeit<br>\nGoods of the World Trade Organization, which Indonesia ratified<br>\nin 1994.<\/p>\n<p>The Indonesian Democratic Party (PDI) stated in its final<br>\noverview that although the amendments were not deliberated as<br>\nthoroughly as they would have liked, they would be good enough to<br>\nprotect intellectual property rights and boost innovation in<br>\nIndonesia.<\/p>\n<p>District courts<\/p>\n<p>In the statement delivered by the party&apos;s spokesman<br>\nWiyandjono, the PDI said it would like more district courts<br>\nestablished to hear cases on trademarks and patents.<\/p>\n<p>&quot;The other factions and the government have agreed to this<br>\nsuggestion, but because more preparation is needed, including for<br>\njudges, (the establishment of the courts) cannot yet be included<br>\nin the amended law,&quot; the spokesman said.<\/p>\n<p>The Armed Forces faction approved the amendments but raised<br>\nseveral questions in its final statement delivered by Sumartini.<br>\nThe Armed Forces suggested that the government immediately issue<br>\ndirectives and other supporting regulations to prevent confusion<br>\nand slow implementation of the amendments.<\/p>\n<p>The United Development Party (PPP) spokesman Oesman Sahidi<br>\nsaid the laws would encourage innovations in sciences, art and<br>\nliterature.<\/p>\n<p>&quot;The laws should also encourage research and findings... so<br>\nthat (Indonesia) can master the technology of industry, the<br>\ntechnology of agriculture, marine, health and other fields,&quot; he<br>\nsaid.<\/p>\n<p>The dominant Golkar asked the government to train staff to<br>\nimplement the laws.<\/p>\n<p>The copyright law was amended to include a provision that<br>\ncopyright on unpublished inventions by anonymous parties will be<br>\nowned by the state, and published inventions by anonymous parties<br>\nwill be owned by their publishers.<\/p>\n<p>The amended law on patents stipulates that the degree of<br>\nnovelty of an invention means that it is not a continuance of a<br>\nprevious work.<\/p>\n<p>&quot;Parallel importation&quot;, which allows the import of a copied<br>\npatented product or service, is stipulated as being acceptable in<br>\nthe new law as long as it has never been produced in Indonesia.<\/p>\n<p>The revamped trademark law says that protection for renowned<br>\nproducts is based on the initiative of their owners, and the<br>\nTrademark Bureau of the Ministry of Justice could guarantee<br>\nprotection by refusing to accept applications for the same<br>\ntrademark.
