Immigration clarifies<\/p>\n
With reference to the letter from Mr. Robert WEM which
\nappeared in The Jakarta Post on July 21, 1999, entitled
\nImmigration law, we would like to give our comment on the matter.<\/p>\n
First of all, and unfortunately, the problem raised by Mr.
\nRobert is unclear, so that it is difficult for us to give a
\nclear-cut response to his state of affairs.<\/p>\n
However, if the discrimination mentioned by Mr. Robert
\ninvolves a foreigner who married an Indonesian woman, we would
\nlike to make it clear that the foreign husband cannot take the
\nstatus of his wife.<\/p>\n
The marriage law in Indonesia is based on a patrilineal
\nprinciple, and the immigration law should stick to that
\nprinciple.<\/p>\n
The adverse will apply if a foreign woman marries an
\nIndonesian man, she can get a Limited Stay Permit in Indonesia,
\nand in line with Law No. 62\/1958 on Indonesian citizenship, the
\nforeign wife is allowed to seek Indonesian nationality.<\/p>\n
Upon observing Mr. Robert's complaint, we assume that Mr.
\nRobert is a German who entered Indonesia using the facility of a
\nVisa Free Short Stay (BVKS), which is valid for 60 days and
\ncannot be extended.<\/p>\n
Should Mr. Robert wish to live in Indonesia together with his
\nwife, he could apply, under the sponsorship of his wife, for a
\nSocial-Cultural Visit Visa, which is initially valid for two
\nmonths. This visa can be extended five times at a maximum of one
\nmonth for each extension.<\/p>\n
