        "content": "<p>Hundreds of residents descended upon the Hidayatul Mukhtar Mosque\nendowment land in Kuripan Village, Kuripan District, West Lombok, on\nThursday to clear the area and install signboards. The land, covering\napproximately four hectares, has been cultivated by residents from\nBabussalam Village in Gerung District. The crowd, comprising mosque\nadministrators and Kuripan villagers, erected six signboards asserting\nthe mosque\u2019s claim to the land as a religious endowment and demanded it\nbe vacated. Kuripan Village Head Hasbi stated that the eviction was\nbased on Mataram District Court Decision No.\u00a0161\/P-N\/1960\/Perdata. He\nexplained that the land had been worked by ten farmers from Bilekedit\nHamlet, Babussalam Village, who were merely cultivators. \u2018We are\nclearing it so that it is not claimed as private property. They are only\ncultivators,\u2019 he said. The eviction was rejected by the farmers. One\ncultivator, Bahar, argued that the action could not be carried out\nwithout a court-ordered execution mechanism. He objected to the process\nbeing based solely on a notification letter regarding the clearance of\nthe mosque\u2019s endowment land, issued by the mosque\u2019s legal counsel. \u2018An\nexecution should be carried out through the court, not just based on a\nletter from their lawyer,\u2019 he stated. Bahar also questioned the validity\nof the endowment status, citing the lack of clarity regarding the\noriginal donor who bequeathed the land to the Hidayatul Mukhtar Mosque.\nHe noted that he had cultivated the land for decades and had been paying\ntaxes on it. The farmers\u2019 legal representative, Ahmad Syaifullah,\nassessed that the eviction was not conducted according to legal\nprocedure. He insisted that any execution of a disputed object must be\ncarried out through the court and involve a bailiff. \u2018Any takeover and\nhandover of the object referred to in the ruling must go through the\ncourt. It cannot be taken over directly like this, as it triggers social\nconflict,\u2019 he said. Syaifullah did not dispute the existence of the 1960\nMataram District Court ruling that declared the land as mosque endowment\nproperty. However, he argued that the issue lay in the execution\nmechanism. He also stated that a constatering, or physical verification\nof the object, was necessary because the physical condition and\nboundaries of the land have changed over more than six decades. \u2018It is\nnot certain that the object described in the 1960 ruling is exactly the\nsame as the physical land controlled by the residents for decades,\u2019 he\nstressed. According to Syaifullah, if the mosque wishes to enforce the\nruling, it should file an execution request with the court so that a\nconstatering can be conducted first. He also suggested that, given the\nland has been occupied by the heirs for decades, the party claiming the\nright to the land could file a lawsuit for unlawful act to legally test\nthe status of the disputed object before requesting execution.<\/p>",
