A member of Indonesia's House of Representatives has called on the Ministry of Communication and Digital Affairs to block access to private electronic system operators (PSEs) that have failed to register. The statement follows a ministry notification to 25 PSEs, including hotel, airline, and fitness app providers, that have not complied with Government Regulation No. 71 of 2019. The legislator emphasised that mandatory registration is crucial for ensuring data protection, security, and fair competition in the digital space.

Jakarta (ANTARA) - Member of Commission I of the Indonesian House of
Representatives (DPR RI) Oleh Soleh has urged the Ministry of
Communication and Digital Affairs (Kemkomdigi) to block electronic
system operators (PSEs) that continue to shirk their obligation to
register.

The statement was made following Kemkomdigi data revealing that 25
private PSEs have yet to register, despite the requirement being
stipulated in Government Regulation No. 71 of 2019 concerning the
Implementation of Electronic Systems and Transactions.

"If after being given the opportunity and a warning they still do not
comply with the rules, I support Kemkomdigi in taking firm steps in
accordance with regulations, including terminating access or blocking.
Law enforcement must be carried out consistently so as not to create the
impression that the rules only apply to certain parties," he said in a
statement on Thursday.

Soleh stressed that all PSEs operating and providing services to the
public are required to register and complete all requirements set by the
government. He argued that PSE registration is not merely an
administrative obligation, but an important instrument for creating a
safe, orderly, transparent, and accountable digital governance.

With all electronic system operators registered, it is believed the
government will find it easier to supervise the protection of personal
data, system security, and compliance with various digital regulations
in Indonesia. He stated that regulatory compliance is a form of
responsibility by operators to the state and society. All digital
companies, whether domestic or foreign, must commit to obeying
Indonesian law if they wish to provide services in the country.

"No party should feel immune to the rules. As long as they operate in
Indonesia and utilise the Indonesian digital market, all electronic
system operators must comply with all applicable provisions," he
said.

Therefore, he supports Kemkomdigi’s move to impose strict sanctions
on operators who continue to ignore the registration obligation. Under
the provisions, private PSEs that fail to meet their obligations may be
subject to sanctions in the form of termination of access to their
electronic systems.

Soleh assessed that the government’s consistency in enforcing the
rules will provide legal certainty for all digital industry players.
This step will also create healthy business competition because all
operators are treated fairly. He hopes this momentum will serve as a
reminder for all digital companies to improve compliance with national
regulations.

On Wednesday (1/7), Kemkomdigi stated that the government had sent
notifications to 25 private PSEs to fulfil their registration
obligations. Broadly speaking, these PSEs are owned by hotel service
providers, airline service providers, and fitness tracking application
service providers.

Three of the 25 PSEs have responded to the government notification
and will immediately fulfil their registration obligations, namely PT
Ayo Indonesia Maju, which owns the AYO Super Sport Community App mobile
application; Six Continents Hotels Inc, which owns the Six Senses mobile
application; and Strava Inc, which owns the Strava fitness tracking
application.

Meanwhile, the remaining 22 PSEs have not shown a similar response
and are still not registered in the system provided by the government.
For these remaining operators, Kemkomdigi issued a written warning on
Thursday.

"Through this warning letter, we are giving PSEs the opportunity to
immediately fulfil their registration obligations before law enforcement
measures are taken in accordance with applicable regulations," said
Alexander Sabar, Director General of Digital Space Supervision at
Kemkomdigi.
",
