        "content": "<p>The dispute over the Hotel Sultan area has heated up again after the\nissuance of an execution order for the evacuation of the Hotel Sultan\nsite by the Central Jakarta District Court.<\/p>\n<p>PT Indobuildco\u2019s legal representative, Hamdan Zoelva, assessed that\ncarrying out this execution could potentially disrupt the investment\nclimate if it is done without considering investors\u2019 rights.<\/p>\n<p>PT Indobuildco is a company owned by Pontjo Sutowo, which has been\nmanaging the Hotel Sultan area in the Gelora Bung Karno (GBK) region,\nCentral Jakarta.<\/p>\n<p>Hamdan stated that in the civil decision Number 208 of 2025, the\npanel of judges did order the evacuation of the Hotel Sultan area.<\/p>\n<p>However, according to him, the judges also emphasised the importance\nof a fair resolution through negotiation and mediation channels.<\/p>\n<p>He noted that this consideration aligns with the Judicial Review\nDecision Number 276 PK\/Pdt\/2011, which affirms that PT Indobuildco\u2019s\nrights as an investor predate the current situation, including the\ninvestments already made on that land.<\/p>\n<p>Hamdan also emphasised that his side will still pursue various legal\nefforts regarding the Hotel Sultan area dispute.<\/p>\n<p>According to the former Chief Justice of the Constitutional Court\n(MK), the legal process for this case is not yet complete, even though\nthere has been an execution order for the evacuation of the Hotel Sultan\nsite by the Central Jakarta District Court.<\/p>\n<p>He stated that PT Indobuildco is still filing appeals and cassation\nfor this case.<\/p>\n<p>\u201cPT Indobuildco respects the courts and every ongoing legal process.\nHowever, the execution of Hotel Sultan should not be forced. Every\nexecution plan must truly adhere to the law and must not ignore\nlegitimate rights, workers\u2019 rights, tenants, and other affected\nparties,\u201d said Hamdan.<\/p>\n<p>According to him, the Hotel Sultan building is not under a build,\noperate, transfer (BOT) scheme, so it cannot be directly taken over or\nexecuted.<\/p>\n<p>He said that if the building is to be taken over or executed, there\nmust be a clear legal mechanism, including compensation payments to the\nbuilding owner.<\/p>\n<p>\u201cThe Hotel Sultan building is not BOT. The building and hotel\nbusiness are the rights of PT Indobuildco. Therefore, the Hotel Sultan\nbuilding cannot be executed just like that. If the building is to be\ntaken or executed, there must be a legal mechanism and compensation\npayments,\u201d Hamdan stated.<\/p>",
