        "content": "<p>Highlights of the 1999 Consumer Protection Law<\/p>\n<p>JAKARTA (JP): The Consumer Protection Law was issued by the<br>\nDirectorate General of Home Trade, Ministry of Industry and Trade<br>\nand enacted on April 20, 1999. It consists of 14 chapters and 65<br>\narticles.<\/p>\n<p>Chapter 1 gives explanations on the terminology used and on<br>\nthe Consumers Protection Society (Lembaga Perlindungan Konsumen<br>\nSwadaya Masyarakat\/LPKS), the Consumers Arbitration Agency (Badan<br>\nPenyelesaian Sengketa Konsumen) and the Consumers Protection<br>\nAgency (Badan Perlindungan Konsumen Nasional).<\/p>\n<p>Chapter 2 contains articles on consumer protection: for<br>\nconsumers, protection awareness improves consumers' ability,<br>\namong others things, to protect themselves, avoid bad experiences<br>\nwhen using products or services, seek legal protection and access<br>\ninformation. On the part of traders, merchants and goods and<br>\nservices suppliers, an awareness of consumer protection compels<br>\nthem to be responsible and to improve the quality of goods and<br>\nservices to ensure the health, comfort, security and safety of<br>\ntheir consumers.<\/p>\n<p>Chapter 3 is about the rights and obligations of consumers and<br>\nthe traders or business entities: consumers have the right to<br>\nenjoy comfort, safety and security when using goods and services,<br>\nto make choices, to have information on the condition and<br>\nguarantee of goods and services, to complain, to have legal<br>\nassistance and to get reimbursement and compensation as<br>\nregulated. Consumers should follow the instructions and<br>\nprocedures when using goods and services; they should also pay as<br>\nappropriate and follow all necessary legal processes.<\/p>\n<p>Traders, merchants and business entities have the right to get<br>\npayments, legal protection and the appropriate advocacy in<br>\nlawsuits against the consumers. They must give thorough<br>\ninformation on the quality standard and specification of goods<br>\nand services on purchase and provide compensation where<br>\nnecessary.<\/p>\n<p>Chapter 4 states points that traders or merchants should not<br>\ndo, including producing goods and services below the specified<br>\nstandards of weight, condition, guarantees and composition.<br>\nProduct labels should contain, among other things, expiry dates,<br>\ntime of usage and halal and non-halal certifications. This<br>\nchapter also provides rules covering the promotion or<br>\nadvertisement of goods and services and regulates the advertising<br>\nbusiness.<\/p>\n<p>Chapter 5 regulates \"fixed clauses\", the binding terms and<br>\nconditions unilaterally set by the businesses that the consumer<br>\ncannot question as stated in their documents.<\/p>\n<p>Chapter 6 lists the responsibilities of businesses, including<br>\nguarantees, spare-parts and after sales service.<\/p>\n<p>Chapter 7 states the government's responsibilities on<br>\noverseeing consumer protection regulations.<\/p>\n<p>Chapter 8 explains the National Consumers Protection Agency<br>\n(Badan Perlindungan Konsumen Nasional) and its handling of<br>\ncontrol, education, protection, and development of human<br>\nresources and research. Articles in this chapter also regulate<br>\nthe membership, and organization of the agency.<\/p>\n<p>Chapter 9 explains the role of the Consumers Protection<br>\nSociety (Lembaga Perlindungan Konsumen Swadaya Masyarakat) in<br>\npromoting consumers' awareness on their rights and obligations.<br>\nThe organization works together with other agencies in assisting<br>\nconsumers in filing complaints\/lawsuits, as well as promoting<br>\npublic control on the consumer protection mechanism.<\/p>\n<p>Chapter 10 regulates the filing of complaints, lawsuits, other<br>\nlegal actions and solutions.<\/p>\n<p>Chapter 11 is about the Consumers Arbitration Agency (Badan<br>\nPenyelesaian Sengketa Konsumen) with regard to membership in the<br>\nagency, its functions, duty and authority.<\/p>\n<p>Chapter 12 sets out the rules for the investigation of<br>\nviolations of consumers' rights.<\/p>\n<p>Chapter 13 is about sanctions.<\/p>\n<p>--Tri Hafiningsih<\/p>",
