I agree with Taufiequrachman, chairman of the Corruption
\nEradication Commission (KPK), who has called on the Indonesian
\nUlemas Council (MUI) to issue a ruling that corruption is
\nforbidden according to Islam.<\/p>\n
While it is true that such a ruling by MUI would help efforts
\nto eradicate corruption, it means little in law enforcement. In
\nfact, our legislation needs an overhaul.<\/p>\n
Take, for example, the taxation regulations. Corruption in the
\ntaxation sector could be reduced if the legal position of
\ntaxpayers, now very weak, could be strengthened.<\/p>\n
The directorate general of taxation may issue a regulation
\nallowing a taxpayer to bring an unreasonable, underpaid tax
\nnotice (SKPKB) to the taxation court without first having to
\nlodge his objection and pay the amount in dispute. The regulation
\nmay also stipulate that any objection or appeal will postpone tax
\ncollection. If the suit fails, the fine the taxpayer will have to
\npay will be increased threefold.<\/p>\n
It is generally known that some tax officers have made use of
\nthe strong position of the directorate general of taxation for
\n"disguised extortion". They can threaten taxpayers or issue a
\nSKPKB stating an unreasonably high amount. That is why many
\ntaxpayers opt for a "win-win solution" with tax collectors.<\/p>\n
In the case of the issuance of an unreasonable SKPKB, for
\nexample, the tax officers concerned could be taken to the
\ntaxation court and punished.<\/p>\n
Unfortunately, the taxation bill drawn up by a team led by
\nAnggito Abimanyu still clearly takes sides with the directorate
\ngeneral of taxation.<\/p>\n
