Ginandjar files second lawsuit over his arrest<\/p>\n
JAKARTA (JP): Lawyers representing former minister of mines
\nand energy Ginandjar Kartasasmita filed on Thursday their second
\nobjection with the South Jakarta District Court against the
\nAttorney General over their client's detention.<\/p>\n
Muchyar Yara, leading the group of lawyers, said that deputy
\nattorney general for special crimes Bachtiar Fachri Nasution
\nissued on Tuesday a new detention warrant for Ginandjar which
\ntook effect for 20 days from April 9 to April 28.<\/p>\n
The warrant was issued following the South Jakarta District
\nCourt's decision on Ginandjar's first complaint, ruling that the
\nsuspect's detention before April 9 was unlawful as it was not
\nissued by a joint investigating team involving military
\nprosecutors and military police.<\/p>\n
Muchyar said Ginandjar, a retired military officer, had
\nrefused on Wednesday to sign the proceedings for the execution of
\nthe new warrant as it had only been signed by Nasution while none
\nof the joint team members had given their signature.<\/p>\n
Muchyar, who was asked to leave Ginandjar's cell on Wednesday
\nnight, after staying there for three consecutive days, also
\nquestioned the retroactive principle in the warrant as recognized
\nby Indonesian law.<\/p>\n
\"How come prosecutors put our client in a cell even though a
\nwarrant was only issued days later? It's not in accordance with
\nany existing laws in this country,\" he added.<\/p>\n
Ginandjar is accused of abusing power in several government
\ncontracts between 1992 and 1995, allegedly causing some US$24.8
\nmillion in losses to the state.<\/p>\n
He has been in detention since April 6.<\/p>\n
Following his detention, Ginandjar's lawyers filed a complaint
\nwith the court.<\/p>\n
Meanwhile, Attorney General's Office spokesman Muljohardjo
\nsaid that the new warrant is lawful although it had not been
\nsigned by military prosecutors and the military police as the
\nteam is under the coordination of Attorney General Marzuki
\nDarusman.<\/p>\n
\"So, it's not necessary for every member of the team to sign
\nthe warrant,\" he told reporters.<\/p>\n
Muljohardjo explained that three military prosecutors, two
\nmilitary policemen and one of the prosecutors, were actually
\nasked to sign the paper for the execution of the new warrant, but
\nthey had refused to give their signatures.<\/p>\n
\"Before showing Ginandjar the proceedings requesting him to
\nsign it on Wednesday evening, the military prosecutors and
\nmilitary policemen contacted their superiors by mobile phones,
\nafter which they decided not to sign the document,\" he explained.<\/p>\n
Ginandjar, deputy speaker of the People's Consultative
\nAssembly from Golkar Party, was an active Air Force vice marshall
\nduring the time in question and retired in 1996. (bby)<\/p>",
