        "content": "<p>Ginandjar files second lawsuit over his arrest<\/p>\n<p>JAKARTA (JP): Lawyers representing former minister of mines<br>\nand energy Ginandjar Kartasasmita filed on Thursday their second<br>\nobjection with the South Jakarta District Court against the<br>\nAttorney General over their client's detention.<\/p>\n<p>Muchyar Yara, leading the group of lawyers, said that deputy<br>\nattorney general for special crimes Bachtiar Fachri Nasution<br>\nissued on Tuesday a new detention warrant for Ginandjar which<br>\ntook effect for 20 days from April 9 to April 28.<\/p>\n<p>The warrant was issued following the South Jakarta District<br>\nCourt's decision on Ginandjar's first complaint, ruling that the<br>\nsuspect's detention before April 9 was unlawful as it was not<br>\nissued by a joint investigating team involving military<br>\nprosecutors and military police.<\/p>\n<p>Muchyar said Ginandjar, a retired military officer, had<br>\nrefused on Wednesday to sign the proceedings for the execution of<br>\nthe new warrant as it had only been signed by Nasution while none<br>\nof the joint team members had given their signature.<\/p>\n<p>Muchyar, who was asked to leave Ginandjar's cell on Wednesday<br>\nnight, after staying there for three consecutive days, also<br>\nquestioned the retroactive principle in the warrant as recognized<br>\nby Indonesian law.<\/p>\n<p>\"How come prosecutors put our client in a cell even though a<br>\nwarrant was only issued days later? It's not in accordance with<br>\nany existing laws in this country,\" he added.<\/p>\n<p>Ginandjar is accused of abusing power in several government<br>\ncontracts between 1992 and 1995, allegedly causing some US$24.8<br>\nmillion in losses to the state.<\/p>\n<p>He has been in detention since April 6.<\/p>\n<p>Following his detention, Ginandjar's lawyers filed a complaint<br>\nwith the court.<\/p>\n<p>Meanwhile, Attorney General's Office spokesman Muljohardjo<br>\nsaid that the new warrant is lawful although it had not been<br>\nsigned by military prosecutors and the military police as the<br>\nteam is under the coordination of Attorney General Marzuki<br>\nDarusman.<\/p>\n<p>\"So, it's not necessary for every member of the team to sign<br>\nthe warrant,\" he told reporters.<\/p>\n<p>Muljohardjo explained that three military prosecutors, two<br>\nmilitary policemen and one of the prosecutors, were actually<br>\nasked to sign the paper for the execution of the new warrant, but<br>\nthey had refused to give their signatures.<\/p>\n<p>\"Before showing Ginandjar the proceedings requesting him to<br>\nsign it on Wednesday evening, the military prosecutors and<br>\nmilitary policemen contacted their superiors by mobile phones,<br>\nafter which they decided not to sign the document,\" he explained.<\/p>\n<p>Ginandjar, deputy speaker of the People's Consultative<br>\nAssembly from Golkar Party, was an active Air Force vice marshall<br>\nduring the time in question and retired in 1996.
