        "content": "<p>Five-year jail term sought for ex-Aspac official<\/p>\n<p>JAKARTA (JP): In the first trial involving the misuse of Bank<br>\nIndonesia's credits, the prosecution asked the South Jakarta<br>\nDistrict Court on Monday to sentence Hendrawan Haryono, the<br>\nformer credit director of the now defunct Bank Aspac, to five<br>\nyears in prison for embezzlement.<\/p>\n<p>Prosecutor Sutyanto said in his indictment the defendant<br>\ncaused the state Rp 538 billion in losses through the<br>\nmisappropriation of state funds channeled to the bank.<\/p>\n<p>The second suspect in the case is Hendrawan's brother Setiawan<br>\nHaryono, the bank's former president. Setiawan will be tried<br>\nseparately by the same court.<\/p>\n<p>Hendrawan stands accused of illegally allocating some of the<br>\nliquidity funds the bank received from Bank Indonesia to<br>\nspeculate in the foreign exchange market and to finance the<br>\noperations of several corporations affiliated with Bank Aspac.<\/p>\n<p>\"The defendant, along with his brother, violated Article 1 of<br>\nthe 1971 law on corruption and Article 49 of the 1998 central<br>\nbank law on corruption,\" the prosecutor said in his indictment.<\/p>\n<p>The prosecutor also asked the court to order the defendant to<br>\nreturn the money to the state and to pay a Rp 38 million fine.<\/p>\n<p>Hendrawan was briefly detained by the Attorney General's<br>\nOffice in April last year, and was then placed under house<br>\narrest.<\/p>\n<p>State prosecutors have filed suits against several banks over<br>\nthe alleged misappropriation of some of the Rp 144.5 trillion<br>\nBank Indonesia channeled to 48 banks between 1997 and 1999 to<br>\nincrease the liquidity of these banks.<\/p>\n<p>The liquidity support funds, known as BLBI, were supposed to<br>\nonly be used to reimburse depositors after massive runs hit the<br>\nbanking industry. But some banks had allegedly used the funds for<br>\nother purposes, including to bail out debt-ridden companies in<br>\ntheir groups.<\/p>\n<p>The Bank Aspac case is the first to come to trial.<\/p>\n<p>The Attorney General's Office has also filed civil lawsuits<br>\nwith the Central Jakarta District Court against Bank Pelita, Bank<br>\nIstimarat, Bank Deka and Bank Centris.<\/p>\n<p>Judge Hirman Purnakusuma adjourned the trial until next<br>\nMonday, at which time the court will hear from the defense.<\/p>\n<p>Meanwhile, Setiawan's trial remains pending due to the<br>\ndefendant's health problems.<\/p>\n<p>Setiawan is currently being treated at the Mitra Keluarga<br>\nHospital in Jatinegara, East Jakarta.<\/p>\n<p>\"The case against Setiawan will soon be filed with the South<br>\nJakarta District Court,\" Attorney General's Office spokesman<br>\nMuljohardjo said.
