Jakarta (ANTARA) - Trisakti University criminal law expert Abdul\nFickar Hadjar has said the Attorney General\u2019s Office can issue a new\ninvestigation order (sprindik) in the case of Febrie Adriansyah if the\nprevious order is annulled through a pretrial hearing.<\/p>\n
\u201cIf sprindik one is annulled, then it can be done with a new\nsprindik,\u201d Fickar said in a statement received in Jakarta on Friday.<\/p>\n
According to him, the issuance of a new sprindik is possible if\ninvestigators still have sufficient supporting evidence to continue\nhandling the case.<\/p>\n
The statement was made in relation to the pretrial motion filed by\nformer Junior Attorney General for Special Crimes (Jampidsus) Febrie\nAdriansyah against the legal process over alleged corruption and money\nlaundering (TPPU) that has ensnared him.<\/p>\n
After the pretrial hearing at the South Jakarta District Court on\nTuesday (18\/8), Febrie\u2019s advocate, Febri Diansyah, said there were 30\nalleged procedural violations in the legal process against his\nclient.<\/p>\n
In addition, Febrie\u2019s side is questioning the process of search,\nseizure, and the naming of a suspect without examining the prospective\nsuspect, the travel ban, and the continued handling of the case at the\nAttorney General\u2019s Office.<\/p>\n
\u201cSo from several of these aspects, we have identified indications of\n30 violations of procedural law and the principles of due process of\nlaw. These 30 will of course be tested further,\u201d Febri said.<\/p>\n
Febri said his side will present a number of experts in the next\nhearing to examine the alleged violations.<\/p>\n
Nevertheless, his side still respects the single judge presiding over\nthe pretrial hearing.<\/p>\n
Febrie has filed two pretrial motions at the South Jakarta District\nCourt.<\/p>\n
The first pretrial motion is registered under case number\n134\/Pid.Pra\/2026\/PN JKT.SEL with the main object being the validity of\nthe forced seizure effort. In the motion, Febrie\u2019s side is also\nquestioning a number of legal actions, including the issuance of the\nsprindik, the search, the suspect designation, and the travel ban.<\/p>\n
The respondents in the case are the Special Criminal Investigation\nDirectorate of the Polda Metro Jaya, the Corruption Eradication Corps of\nthe National Police, and the Investigation Directorate of the Junior\nAttorney General for Special Crimes.<\/p>\n
Meanwhile, the second pretrial motion is registered under case number\n135\/Pid.Pra\/2026\/PN JKT.SEL which examines the validity of Febrie\u2019s\ndesignation as a suspect by the Attorney General\u2019s Office.<\/p>\n
Meanwhile, the National Police previously named Febrie as a suspect\nin alleged corruption and money laundering in the handling of the PT\nAsabri case for the 2020\u20132024 period.
