Former Deputy Attorney General for Special Crimes (Jampidsus) Febrie\nAdriansyah is alleged to have received Rp40 billion from businessman Tan\nKian. The allegation surfaced during a pretrial ruling at the South\nJakarta District Court concerning the Asabri and Jiwasraya corruption\ncases.<\/p>\n
Sole judge Richard Edwin Basoeki revealed that testimony regarding\nthe handover of the money formed part of the evidence held by\ninvestigators. The money was given in Singapore dollars with an\nequivalent value of Rp40 billion.<\/p>\n
\u201cConsidering that one of the statements referred to as part of the\nevidence is Tan Kian\u2019s testimony regarding the handover of money in\nSingapore dollars with an equivalent value of Rp40 billion to the\npetitioner, which according to the testimony was related to the legal\nissues of Jiwasraya and\/or Asabri,\u201d Richard said while reading the\nruling on Thursday (27\/8\/2026).<\/p>\n
The judge stated that the police had obtained statements from a\nnumber of witnesses regarding Febrie\u2019s communications with parties\nrelated to the Jiwasraya and Asabri cases before conducting the search.\nIn addition to witness testimony, investigators also possessed documents\nand transaction data deemed mutually corroborating.<\/p>\n
Based on this evidence, the judge found sufficient preliminary\nevidence, namely at least two pieces of evidence as stipulated in\nArticle 235 paragraph 1 of Law Number 20 of 2025.<\/p>\n
However, Richard emphasised that the pretrial hearing only examines\nthe legality of formal actions such as searches, seizures and the naming\nof suspects, not to prove the material truth of the alleged payment.<\/p>\n
\u201cThe mention of this evidence does not mean the judge declares the\nwitness testimony about the handover of money to be true or that the\npetitioner is proven to have committed a criminal offence. The\nassessment at the pretrial stage is only to determine whether there was\nan objective basis before the action was taken,\u201d he stressed.<\/p>\n
In his ruling, the judge rejected all pretrial motions filed by\nFebrie under case registration number 134 Pid.Pra\/2026\/PN JKT.SEL. The\njudge considered that the absence of the Attorney General\u2019s permission\nfor the search did not render the action invalid, given the exception in\nConstitutional Court Decision Number 15\/PUU-XXIII\/2025 for cases of\nserious crime or caught in the act.<\/p>\n
For information, in this case Febrie acted as the petitioner, while\nthe respondents were Polda Metro Jaya and the Police Corruption\nEradication Corps (Kortas Tipikor), with the Attorney General\u2019s Office\nas a co-respondent.<\/p>\n
In addition to this case, Febrie also filed a second pretrial motion\nunder case number 135\/Pid.Pra\/2026\/PB JKT.SEL regarding the legality of\nhis naming as a suspect by the Deputy Attorney General for Special\nCrimes.
