        "content": "<p>Expert gives evidence against KPU hacker<\/p>\n<p>Urip Hudiono, The Jakarta Post, Jakarta<\/p>\n<p>An expert witness testified on Tuesday that accused hacker Dani<br>\nFirmansyah violated stipulations in the Law on Telecommunications<br>\nwhen he allegedly gained illegal access to the website of the<br>\nGeneral Elections Commission (KPU).<\/p>\n<p>Legal expert Edmon Makarim from the University of Indonesia&apos;s<br>\nResearch Institute for Law and Technology told the Central<br>\nJakarta District Court that Dani gained &quot;unauthorized access&quot; to<br>\nthe KPU&apos;s IT system, and &quot;caused a disturbance that caused the<br>\nsystem to fail to function properly&quot;.<\/p>\n<p>Dani is charged under Article 22 of the telecommunications law<br>\nfor illegally accessing a telecommunications network and\/or<br>\nservice, and Article 38 of the same law for causing a physical or<br>\nelectromagnetic disturbance to a telecommunications service.<\/p>\n<p>The articles carry a maximum sentence of six years in prison<br>\nand\/or a fine of Rp 600 million.<\/p>\n<p>In earlier hearings, the judges, prosecutors and Dani&apos;s<br>\nlawyers argued over whether the KPU&apos;s IT system was a<br>\ntelecommunications network and whether the defendant&apos;s actions<br>\nhad physically disrupted the system.<\/p>\n<p>Edmon said the KPU&apos;s IT system -- including its website --<br>\ncould be considered a telecommunications network because it was<br>\nused to connect two parties and exchange information between<br>\nthem.<\/p>\n<p>Edmon also said a physical disturbance did not have to involve<br>\nonly a system&apos;s hardware, but could included &quot;the integrity of<br>\nthe website&apos;s information&quot;.<\/p>\n<p>&quot;Disrupting this information remotely using computers could<br>\nfurther be considered as an electromagnetic disturbance, because<br>\ncomputers essentially work by the principles of<br>\nelectromagnetism,&quot; he said.<\/p>\n<p>Presiding judge Hamdi adjourned the trial until Oct. 19, at<br>\nwhich time the court will hear testimony from more witnesses.<\/p>",
