Various efforts have been undertaken to eradicate land mafia\npractices. However, instead of stopping corrupt practices in the land\nadministration process, cases are actually increasing. As reported in\nthe mass media, the Corruption Eradication Commission (KPK) has named\neight individuals as suspects in an alleged corruption case involving\nland or the administration of Building Use Rights (HGB) in Bogor\nRegency, West Java.<\/p>\n
These fraudulent practices in land administration have implicated\ntrusted associates of the Minister of ATR\/BPN, the Head of the Bogor\nRegency Land Office I, and even the President Director of PT Summarecon\nAgung. The Acting Director of Investigations at the KPK, Achmad Taufcal,\nrevealed this during a press conference broadcast live on Tuesday\nevening, 15 September 2026. This land mafia case was uncovered following\na sting operation (OTT) by the KPK, where 19 individuals were detained\nby investigators across the Jabodetabek area.<\/p>\n
It is believed that irregularities in land permit issuance are not\nlimited to Bogor. It is highly probable that in other regions undergoing\ndevelopment into industrial, office, and modern residential areas,\nfraudulent practices in HGB administration still frequently occur on\nvarying scales. In areas being developed into modern cities, land has\ntransformed into a highly valuable commodity. Collusion growing between\ncorrupt bureaucrats, land brokers, greedy corporations, and law\nenforcement officials often exploits the business permit process as an\nobject of extortion.<\/p>\n
Main Factors<\/strong><\/p>\n Corruption in the issuance, extension, and transfer of HGB in various\nregions has arguably developed into a structured, systematic, and\nmassive system. For the community, land is a living space, an identity,\nand a future heritage. However, for corporations, land is often a\ncommercial commodity traded for profit.<\/p>\n So far, land mafia practices have been so difficult to eradicate\nbecause the root of the problem lies in the complex bureaucracy of land\nadministration. Land mafias do not operate in isolation. They operate\nwithin a criminal ecosystem that brings together financiers, legal\nservice providers, brokers, and officials within government institutions\nat various levels.<\/p>\n The primary factor allowing land mafia networks to persist over time\nis the principle of mutual benefit, or a symbiotic relationship between\nthe mafia and public officials. Property developers certainly require\nrapid legality to secure investments and obtain bank loans. Meanwhile,\ncorrupt bureaucrats require cash payments to enrich themselves, fund\nluxurious lifestyles, or finance political positions. On the other hand,\ninternal supervision within the National Land Agency (BPN) is often\nineffective because the supervisors themselves often enjoy the flow of\nillicit funds from these entrepreneurs.<\/p>\n Based on experience, it is impossible for a fake or duplicate land\ncertificate to be issued without the involvement\u2014either active or\npassive due to negligence\u2014of officials within the Ministry of Agraria\nand Spatial Planning\/National Land Agency (ATR\/BPN), village or\nsub-district officials, notaries\/PPAT, and law enforcement\nofficials.<\/p>\n When bureaucratic officials, who should be serving and facilitating\nthe rights of the people, instead initiate taking profits behind the\ncommunity\u2019s helplessness, no matter how strong the law is, it will\ninevitably be breached and exploited for personal interests. The\ninvolvement of \u2018insiders\u2019 in institutions with the authority to issue\nland permits provides formal legal legitimacy to actions that are\nsubstantially illegal. Consequently, small-scale citizens who lack\naccess to power and financial capital are certain to lose when facing\nofficial documents held by the mafia. Instances of land mafias forcibly\nseizing land belonging to others have occurred repeatedly across the\ncountry.<\/p>\n In many cases, land mafia perpetrators typically use fake land deeds,\nfictitious \u2018girik\u2019 (customary land documents), or manipulate historical\nownership documents. However, in today\u2019s digital postmodern era, these\nland mafia actors are even capable of forging authentic documents,\nfiling fictitious lawsuits in court, and exploiting legal loopholes in\nthe Systematic Land Registration (PTSL) process.<\/p>\n Learning from experience, one of the most vulnerable points often\nexploited is vacant, abandoned, or land belonging to elderly citizens\nwho lack legal understanding. With documents that are \u2018suddenly\u2019\ncomplete and valid on paper, land mafias are able to reverse the\nownership status of others\u2019 land to their own. Ironically, the victims,\nwho are the original owners, are often shocked to find that their land\nhas been transferred or executed by the court without them ever knowing\nabout the dispute process. Such cases occur not only in peripheral areas\nbut also frequently on prime city centre lands belonging to those\nwithout strong legal access.<\/p>\n Enforcing Justice<\/strong><\/p>\n Eradicating corrupt practices in the land permit process,\nparticularly those involving officials within the Ministry of ATR\/BPN,\ncertainly cannot be achieved overnight. This is a long-term war that\ndemands extraordinary political courage from the nation\u2019s top leadership\nand law enforcement agencies. Without strong political will from the\nPresident and the presiding Ministers, all eradication programs will\nmerely become seasonal political commodities ahead of elections.<\/p>\n Cleaning the ATR\/BPN institution from the contamination of corruption\nis not just about improving government administrative governance, but is\na strenuous effort to restore human dignity and\u2026<\/p>",
