Eng San gets 17 years for his role in murder<\/p>\n
JAKARTA (JP): Hasan, alias Eng San, a businessman, was
\nsentenced to 17 years' imprisonment by the North Jakarta District
\nCourt yesterday for persuading other people to kill Nyo Beng
\nSeng, his rival, two years ago.<\/p>\n
Presiding Judge Bhaedowie said Eng San, 40, was found guilty
\nof violating Article 55 of the Criminal Code, which carries a
\nmaximum life sentence.<\/p>\n
The sentence was three years higher than what prosecutor Andhi
\nNirwanto had demanded two weeks ago.<\/p>\n
Bhaedowie said Eng San had worsened his own case by faking an
\nillness, which had hampered the hearings. Eng San was brought to
\ncourt in January this year and trials were frequently delayed.<\/p>\n
\"Medical examinations revealed that the defendant was
\ncompletely healthy,\" the judge said.<\/p>\n
\"The defendant also had the heart to induce others to kill his
\nown friend,\" Bhaedowie said. He also said Eng San had been jailed
\nbefore for gambling.<\/p>\n
The others involved with the killing were Agiono, Atok and
\nTjen Piu.<\/p>\n
The same court sentenced the first two men in August last year
\nas accomplices in the crime.<\/p>\n
Agiono and Atok are now serving 20-year and 15-year prison
\nterms respectively. Tjen Piu got nine years' imprisonment last
\nOctober for escorting the two men to Nyo Beng Seng's mansion in
\nSunter, North Jakarta.<\/p>\n
The prosecution said one motivation behind the murder was
\nbecause Eng San had owed the victim US$3.2 million. The money was
\npart of funds needed to set up a casino in Cambodia by Eng San
\nand Nyo Beng Seng.<\/p>\n
After the verdict Eng San's lawyers -- Soedjono, Teguh Samudra
\nand Harjono Tjitrosoebono, who heads the Indonesian Bar
\nAssociation, Ikadin -- said they would appeal to the Jakarta High
\nCourt.<\/p>\n
State prosecutor Andhi Nirwanto refused to comment.<\/p>\n
Last week in his defense, Eng San had said the trial was
\ndesigned to implicate him deeper despite the involvement of two
\nother people in the crime. He was referring to businessmen who he
\nsaid were Nyo Beng Seng's competitors.<\/p>\n
Eng San also said he was once told by a certain prosecutor to
\nescape but he refused, only to find himself thrown behind bars.<\/p>\n
Yesterday Eng San, who wore a black outfit, looked uneasy. He
\nglanced back to the audience several times but smiled when
\ncameras flashed.<\/p>\n
The courtroom was packed with spectators, including the
\ndefendant's family and friends. Several yelled \"injustice\" right
\nafter Bhaedowie finished reading the verdict.<\/p>\n
After the session, Eng San looked more relaxed. He said the
\npunishment was not a surprise to him, because he had heard about
\nit long before the hearing began.<\/p>\n
After the trial, lawyer Soedjono said he had heard that many
\npeople had wagered on the verdict.<\/p>\n
Judge Bhaedowie had earlier asked the prosecutor and lawyers
\nto bring in three other witnesses -- Eng San's business partners,
\nHong Lie, A Gun and Kiki Ariyanto -- who had sent written
\ntestimonies, but failed to show up.<\/p>\n
Hong Lie and A Gun were reportedly in Hong Kong, with gambling
\nbusinesses in Kuala Lumpur, Hong Kong and Macao. Police had said
\nearlier the two businessmen were also implicated in the murder
