Eddy Tansil makes last ditch attempt at peace<\/p>\n
JAKARTA (JP): Businessman Eddy Tansil, with an imminent
\ncorruption indictment hanging over him, made a last ditch effort
\nto settle his debts with the government by offering all the
\nassets of his business empire.<\/p>\n
Gani Djemat, the prominent lawyer hired to defend Tansil,
\nyesterday during a hearing at the Central Jakarta District Court,
\ngave the breakdown of the value of the assets belonging to the
\nGolden Key Group which is owned by the businessman.<\/p>\n
Gani insisted that the government stands to recover Rp 1.5
\ntrillion from the assets, which is more than the Rp 1.3 trillion
\nthe government has reportedly lost through Tansil's dealings with
\nthe state-owned Bank Pembangunan Indonesia (Bapindo).<\/p>\n
Government prosecutors had earlier rejected Tansil's peace
\noffer, saying that the lawyers had inflated the value of some of
\nthe industrial ventures that were on offer.<\/p>\n
Tansil is being charged for corruption for swindling Bapindo
\nof more than $448 million in his loan dealings.<\/p>\n
Gani said at the hearing yesterday that his client was
\nprepared to hand over eight industrial ventures, with a combined
\nbook value of Rp 1.231 trillion.<\/p>\n
One venture is the PT Hamparan Rejeki, alone worth Rp 534
\nbillion, he said, stressing that the value came from an
\nindependent evaluation from an appraisal company and a registered
\npublic accountant.<\/p>\n
\"If non material assets such as goodwill and others were also
\nincluded in the calculation, the total assets could reach an
\nestimated Rp 1.5 trillion,\" he said.<\/p>\n
The same evaluators also found that the total debts of the
\ncompanies to Bapindo and another three government banks, Bank
\nDagang Negara (BDN), Bank Bumi Daya (BBD) and Bank BNI totaled Rp
\n1.214 trillion, he said.<\/p>\n
The evaluation covered all of the companies' assets including
\nland and buildings, inventory, machinery and equipment, and other
\nproperty.<\/p>\n
\"The appraisal company employed by the prosecutors simply
\nlooked at the land and buildings,\" he said, pointing out that the
\nvalue of the land was assessed at Rp 65,000 per square meter, far
\nbelow the going market price of Rp 250,000.<\/p>\n
Life imprisonment<\/p>\n
Responding to the gesture, chief prosecutor Lukman Bachmid
\nagain said that he highly doubted the figures presented by
\nTansil's lawyers.<\/p>\n
The hearing was adjourned till next Monday when the court is
\nscheduled to read its verdict.<\/p>\n
Lukman is pressing for life imprisonment and has asked the
\ncourt to order Tansil to pay Rp 800 billion to the government and
\nanother Rp 30 million penalty.<\/p>\n
Maman Suparman, the former deputy manager of Bapindo's Jakarta
\nbranch who dealt with Tansil, was sentenced to nine years in jail
\nby the South Jakarta District Court for his part in allowing
\nTansil to swindle the bank.<\/p>\n
Two former Bapindo directors, Subekti Ismaun and Towil
\nHeryoto, are now being tried at the South Jakarta District Court
\nfor their role in the scam. Two other former directors, Bambang
\nKuntjoro and Sjahrizal, are waiting for arraignment.<\/p>\n
Gani in his defense statement, again urged the judges to throw
\naway the case saying that if anything, Tansil should have been
\ntried for civil wrong and not for crime. He pointed out that
\nBapindo is also suing his client through the Hong Kong High
\nCourt.<\/p>\n
One of Tansil's companies, the Golden Step Development of Hong
\nKong, was the recipient of funds from Bapindo's Hong Kong branch.<\/p>\n
Meanwhile, lawyers representing Subekti yesterday urged the
\nSouth Jakarta District Court to dismiss the trial on technical
\nand procedural grounds.<\/p>\n
Amir Syamsuddin, heading Subekti's defense team, said the
\nprosecution's case was too vague and pointed out what he
\nperceived to be weaknesses in the dossiers, including vague
\nwordings and the use of incorrect banking and finance terms.<\/p>\n
The lawyer said the prosecution's case is not relevant since
\nit accuses the defendant of corruption crimes for managerial
\nmistakes performed by Subekti as president of the bank. (05)<\/p>",
