Eddy Pianto optimistic to win<\/p>\n

A lawyer voiced optimism about winning a court battle against
\nthe Indonesian affiliate of U.S. based PricewaterhouseCoopers
\n(PwC) after gaining support from the Business Competition
\nSupervisory Commission (KPPU).<\/p>\n
Wawan Iriawan, who represents accountant Eddy Pianto, said the
\nrecent ruling by the KPPU against PwC-affiliated accounting firm
\nHadi Sutanto and Associates, would strengthen his client's
\nposition in his legal dispute with the firm.<\/p>\n
\"We shall present the KPPU's ruling as evidence in court,\"
\nWawan said.<\/p>\n
Eddy filed in March a lawsuit against Hadi Sutanto as well as
\nstate owned telecommunciation firm PT Telkom, the Capital Market
\nSupervisory Agency (Bapepam) and accounting firm Deloitte Touche
\nTohmatsu for illegalities that harmed his reputation and
\ninflicted losses on him.<\/p>\n
He demanded compensation amounting to Rp 7.84 trillion (about
\nUS$834 million).<\/p>\n
Eddy was the former auditor of Telkom. The legal battle began
\nafter the U.S. Securities and Exchange Commission (SEC) rejected
\nTelkom's 2002 financial report. Telkom later appointed Hadi
\nSutanto, the auditor of PT Telkomsel, a subsidiary of Telkom, to
\nreaudit the financial report.<\/p>\n
The SEC rejected the Telkom 2002 financial report because it
\nwas considered incomplete as Hadi Sutanto refused to give a
\nconsent letter to Eddy to use its audit report on Telkomsel,
\nTelkom's cellular subsidiary.<\/p>\n
Aside from filing the lawsuit at the South Jakarta District
\nCourt, Eddy also filed a request for the KPPU to examine the
\ncase.<\/p>\n
Last week, the KPPU ruled that Hadi Sutanto had engaged in
\nunfair practices and imposed a fine of Rp 20 billion.<\/p>\n
One of the reasons cited by Hadi Sutanto for his refusal to
\ngive a consent letter to Eddy to use the Telkomsel audit was that
\nthe former doubted the latter's qualifications to audit the
\ncompany in line with SEC rules.<\/p>\n
Hadi Sutanto said it feared the potential risks of being
\nimplicated in case of any mistakes made by Eddy.<\/p>\n
The KPPU insisted, however, that Hadi Sutanto had no right to
\njudge the qualifications of Eddy.<\/p>\n
\"The right to judge (Eddy's qualifications) lies with the SEC.
\nHadi Sutanto should have asked for clarification from the SEC.
\nBut, it did not do that,\" KPPU said.<\/p>\n
Hadi Putranto's office refused to comment on Monday. A
\nsecretary named Gesty failed to send a press statement which she
\npromised on Monday.<\/p>",
