Indonesia's parliament has clarified that the revision of the Financial Sector Development and Strengthening Law (UU P2SK) accommodates the establishment of a mineral and strategic commodity exchange to boost economic growth. The amendment was initially driven by Constitutional Court rulings on financial crime investigations and the independence of the Indonesia Deposit Insurance Corporation. Lawmakers expect the new commodity exchange, alongside state-owned PT Danantara Sumberdaya Indonesia, to ensure transparent price formation and enable Indonesia to play a more active role in setting global prices for commodities like palm oil, coal, and nickel.

Jakarta, CNBC Indonesia - Commission XI of the Indonesian House of
Representatives (DPR RI) has spoken out about the reasons for revising
the Financial Sector Development and Strengthening Law (UU P2SK), which
was officially enacted last Thursday (4/6/2026). Mohamad Hekal, Deputy
Chairman of Commission XI and a member of the working committee for the
amendment bill, stated that this revision was undertaken to implement
Constitutional Court (MK) decisions regarding criminal investigations in
the financial sector and the independence of the Indonesia Deposit
Insurance Corporation (LPS). “So regarding this law revision, the
urgency actually did not originate from us. Initially, this law is still
relatively new, a 2023 law. However, there are two Constitutional Court
rulings that mandate it must be revised,” Hekal told CNBC Indonesia,
quoted on Thursday (11/6/2026). “First, concerning criminal offences in
the financial sector which previously could only be investigated by the
Financial Services Authority (OJK); according to the MK, a single
investigation authority is not permissible. The second concerns the
independence of the LPS, where its budget decisions were previously
handled by the Ministry of Finance. As an independent institution, these
decisions should be made by the DPR,” he continued. Hekal explained that
with this revision, the financial sector can be developed for national
economic growth. “We are using this revision opportunity to
simultaneously develop and enrich the financial sector as a vital artery
for economic growth. Naturally, we utilise this because P2SK is a law
with a very broad scope, and we use it at once to improve and adapt to a
dynamic economic environment,” he explained. Several notable policies
within the P2SK Law include strengthening financial authorities such as
Bank Indonesia, OJK, and LPS, bolstering the Strategic Mineral Exchange,
reinforcing Danantara, reforming the capital market, enhancing the
digital economy, and advancing global financial ambitions through the
Indonesia International Financial Centre. The revision also accommodates
the establishment of a commodity exchange, specifically PT Danantara
Sumberdaya Indonesia (DSI). “We hope that precisely with the presence of
DSI, and by including the Mineral and Strategic Commodities Exchange in
the UU P2SK, they will operate simultaneously. So that no party feels
the process is non-transparent or biased, and prices are formed
naturally. That is where we include the Exchange. So everything will be
very transparent and easily accessible, that is our hope,” he clarified.
By incorporating the strategic commodity exchange into the UU P2SK, a
reference price will be formed based on domestic production levels.
“Currently, Indonesia is the number one exporter of palm oil, the number
one exporter of coal in the world, likewise for nickel. Yet oddly, no
price is determined in Indonesia. So, we certainly hope that with this
formation and a single gate for its sales, we can play a far more active
role in price formation, based on conditions in Indonesia,” he stated.
Hekal also expressed hope that the P2SK revision, which now requires OJK
oversight of the commodity exchange, will ensure smooth transactions for
state revenue within the financial sector.
",
