Jakarta, CNBC Indonesia - The administration of President Prabowo\nSubianto is reportedly planning to create a State-Owned Enterprise\n(BUMN) Special Export for a number of commodities, such as coal and palm\noil. The issue has been confirmed directly to several cabinet ministers,\nincluding Energy and Mineral Resources Minister Bahlil Lahadalia,\nInvestment\/Head of BKPM Rosan P. Roeslani, and Finance Minister Purbaya\nYudhi Sadewa.<\/p>\n

The officials were in fact reluctant to comment in detail on the\nplan. However, they asked to wait until this is truly completed. \u2018Just\nwait and see,\u2019 Rosan said at the Office of the Ministry of Energy and\nMineral Resources. \u2018We will see later,\u2019 said Bahlil yesterday\n(20\/5\/2026). \u2018Gosh, I don\u2019t know, the President will announce it,\u2019 said\nPurbaya.<\/p>\n

Meanwhile, according to CNBC Indonesia\u2019s findings, the government is\nactually drafting regulations for the establishment of this Special\nExport State-Owned Enterprise. In fact, the draft has already circulated\namong mining entrepreneurs.<\/p>\n

From the draft received by CNBC Indonesia, the regulation will be in\nthe form of a Government Regulation (PP) on \u2018Governance of Exports of\nStrategic Natural Resource Commodities Through State-Owned\nEnterprises\u2019.<\/p>\n

This draft has not yet been signed by President Prabowo Subianto.\nHere is the content of the draft that circulates:<\/p>\n

Chapter I<\/p>\n

GENERAL PROVISIONS<\/p>\n

Article 1<\/p>\n

In this Government Regulation, the following definitions apply:<\/p>\n

    \n

  1. Export means the activity of removing goods from the Indonesian\ncustoms area.<\/p><\/li>\n

  2. Strategic Natural Resource Commodities are natural resource\ncommodities designated by the Government, taking into account national\ninterest, economic stability, domestic needs, and\/or management of\nstrategic national natural resources.<\/p><\/li>\n

  3. State-Owned Enterprise hereafter abbreviated as BUMN is an entity\nthat meets at least one of the following:<\/p><\/li>\n<\/ol>\n

      \n

    1. all or the majority of its capital is owned by the Republic of\nIndonesia through direct participation; or<\/p><\/li>\n

    2. there are privileges held by the Republic of Indonesia.<\/p><\/li>\n<\/ol>\n

        \n
      1. Export BUMN, hereafter called BUMN Export, is a BUMN that has been\nassigned a special mandate by the Government to carry out the export of\nStrategic Natural Resource Commodities.<\/li>\n<\/ol>\n

        Chapter II<\/p>\n

        DETERMINATION OF STRATEGIC NATURAL RESOURCE COMMODITIES<\/p>\n

        Article 2<\/p>\n

          \n
        1. Strategic Natural Resource Commodities subject to export governance\ninclude:<\/li>\n<\/ol>\n
            \n

          1. coal;<\/p><\/li>\n

          2. palm oil; and<\/p><\/li>\n

          3. other Strategic Natural Resource Commodities.<\/p><\/li>\n<\/ol>\n

              \n
            1. The Government may change the Strategic Natural Resource Commodities\nas referred to in paragraph (1) letters a and b and designate other\nStrategic Natural Resource Commodities as referred to in paragraph (1)\nletter c through a coordination meeting chaired by:<\/li>\n<\/ol>\n
                \n

              1. the minister responsible for coordinating and synchronising and\ncontrolling the execution of affairs of the ministry in charge of\neconomic governance; or<\/p><\/li>\n

              2. the minister responsible for coordinating and controlling affairs\nin the field of agriculture,<\/p><\/li>\n<\/ol>\n

                attended by ministers\/head of non-ministerial government bodies.<\/p>\n

                  \n
                1. The designation of changes to Strategic Natural Resource Commodities\nand designation of other Strategic Natural Resource Commodities as\nreferred to in paragraph (2) shall be set out in a ministerial\nregulation dealing with trade affairs.<\/li>\n<\/ol>\n

                  Chapter III<\/p>\n

                  EXPORT GOVERNANCE<\/p>\n

                  Article 3<\/p>\n

                    \n

                  1. The Strategic Natural Resource Commodities referred to in Article\n2 may only be exported by a BUMN Export.<\/p><\/li>\n

                  2. The BUMN Export referred to in paragraph (1) shall be designated\nin accordance with the regulations governing state-owned\nenterprises.<\/p><\/li>\n<\/ol>\n

                    Article 4<\/p>\n

                      \n
                    1. Export governance of Strategic Natural Resource Commodities as\nreferred to in Article 2 may be conducted through:<\/li>\n<\/ol>\n
                        \n

                      1. Export controls; and\/or<\/p><\/li>\n

                      2. other mechanisms in accordance with the provisions of the laws\nand regulations.<\/p><\/li>\n<\/ol>\n

                          \n
                        1. Further provisions on export governance of Strategic Natural\nResource Commodities as referred to in paragraph (1) shall be set by\neach minister\/head of the relevant non-ministerial government agencies\nin accordance with their authority.<\/li>\n<\/ol>\n

                          Chapter IV<\/p>\n

                          GUIDANCE AND SUPERVISION<\/p>\n

                          Article 5<\/p>\n

                          Guidance and supervision of the implementation of export governance\nof Strategic Natural Resource Commodities shall be conducted by each\nminister\/head of the relevant non-ministerial government agencies in\naccordance with their authority.<\/p>\n

                          Chapter V<\/p>\n

                          TRANSITIONAL PROVISIONS<\/p>\n

                          Article 6<\/p>\n

                          Upon the entry into force of this Government Regulation:<\/p>\n

                          1. Export of Strategic Natural Resource Commodities as referred to\nin Article 2 may be conducted only through a BUMN Export until 31\nDecember 2026.<\/p><\/li>\n

                          2. Exports of Strategic Natural Resource Commodities under Article 2\nafter 31 December 2026 shall be conducted only by BUMN Export.<\/p><\/li>\n

                          3. If the implementation of Export of Strategic Natural Resource\nCommodities under Article 2 has already been fully transferred to BUMN\nExport before 31 December 2026, export shall be conducted in accordance\nwith the provisions as referred to in item b.<\/p><\/li>\n<\/ol>\n
