        "content": "<p>JAKARTA, KOMPAS.com - The formation of ad hoc teams to investigate\nalleged human rights violations will be among the provisions in the\ndraft Human Rights Bill.<\/p>\n<p>This is stipulated in Article 84(3) of the draft Human Rights Bill,\nwhere the establishment of such teams falls under the authority of the\nNational Human Rights Commission (Komnas HAM).<\/p>\n<p>\u2018If deemed necessary, Komnas HAM may form an ad hoc investigation\nteam for alleged human rights violations composed of national human\nrights institution and community representatives,\u2019 states Article 84(3)\nof the draft Human Rights Bill, downloaded from the Ministry of Human\nRights website, cited on Monday, 25 May 2026.<\/p>\n<p>Article 84(4) of the draft stipulates that Komnas HAM shall submit\nthe results of investigations and inquiries into human rights violations\nwith criminal elements to law enforcement authorities for follow-up in\naccordance with applicable regulations.<\/p>\n<p>\u2018Komnas HAM shall prepare and submit recommendations from studies,\nmonitoring, and\/or mediation to relevant ministries, agencies, local\ngovernments, and parties concerned, with a copy to the Minister for\nfollow-up,\u2019 states Article 84(5) of the draft Human Rights Bill.<\/p>\n<p>\u2018Recommendations issued by Komnas HAM must be approved through a\nPlenary Session and be binding,\u2019 states Article 86(1) of the draft Human\nRights Bill, cited on Monday, 25 May 2026.<\/p>\n<p>Article 86(2) of the draft Human Rights Bill states that\nrecommendations issued by Komnas HAM must be followed up by relevant\nministries, agencies, or local governments.<\/p>\n<p>\u2018Recommendations by Komnas HAM concerning economic, social, and\ncultural rights shall be coordinated by the Minister during\nimplementation,\u2019 states Article 86(3).<\/p>\n<p>Conversely, the revision will strengthen Komnas HAM\u2019s position, as\nits powers will be expanded.<\/p>\n<p>The enhancements include authority to conduct investigations, summon\nwitnesses, prosecute, provide amicus curiae in court, and issue binding\nrecommendations.<\/p>\n<p>\u2018Today, Komnas HAM has limited powers: receiving complaints,\nmonitoring, and conducting investigations.
