A member of Commission I of the House of Representatives, Tubagus\nHasanuddin, has requested that the military trial in the Andrie Yunus\ncase be opened to the public. The aim is for the public to monitor the\nproceedings of the acid attack case against the Deputy Chairman of the\nCommission for Missing Persons and Victims of Violence (Kontras).<\/p>\n
\u201cOpened openly and transparently. So that society can provide the\nbest possible contribution to achieve justice in the best possible way,\u201d\nhe said at the PDI Perjuangan Party School Office in South Jakarta on\nSaturday, 18 April 2026.<\/p>\n
Article 65 paragraph (2) of Law No.\u00a034 of 2004 on the TNI states that\nsoldiers are subject to general courts for general criminal acts.\nHowever, Law No.\u00a031 of 1997 on Military Justice, which has not yet been\nrevised despite amendments to the TNI Law, is still in effect. According\nto him, the Military Justice Law is still implemented even though the\nTNI Law has been revised. \u201cSo all actions of soldiers, whether\nsemi-military, military, or civilian, are still handled in military\ncourts,\u201d he said.<\/p>\n
This retired Major General TNI suggested that a revision of the\nMilitary Justice Law is necessary. TNI soldiers who commit general\ncriminal acts must be processed in general courts. \u201cAs long as the law\nhas not been changed, we must adhere to the principle of following\nmilitary courts,\u201d he said.<\/p>\n
The Military Court II-08 Jakarta previously received the case file\nfor the acid attack on Andrie Yunus, which was handed over by the\nMilitary Prosecutor II-07 Jakarta. The Head of Military Court II-08\nJakarta, Colonel Fredy Ferdian Isnartanto, claimed that the body he\nleads meets the requirements for absolute and relative jurisdiction to\ntry this case.<\/p>\n
\u201cIf it were in a civilian court, it wouldn\u2019t be accepted; it would be\nwrong, and the legal process wouldn\u2019t proceed. It could be rejected by\nthe district court,\u201d said Fredy during a press conference at Military\nCourt II-08 Jakarta on Thursday, 16 April 2026.<\/p>\n
He explained that the four defendants in this trial are Indonesian\nNational Army (TNI) personnel. Therefore, he said, his side has absolute\nauthority to try them.<\/p>\n
Meanwhile, for relative jurisdiction, the acid attack case on Andrie\non 12 March took place on Jalan Salemba, Central Jakarta. Thus, the\nlocus of the case falls under the relative jurisdiction of the Jakarta\nMilitary Court. The same applies to the legal territorial unit.<\/p>\n
Furthermore, his side is also authorised to try the four defendants\nbased on their ranks. He mentioned that the four defendants are Captain\nNDP, First Lieutenant BHW, First Lieutenant SL, and Second Sergeant ES.\n\u201cBecause if they are mid-level officers, it would be at the High\nMilitary Court II Jakarta. So I can explain that it falls under the\njurisdiction,\u201d he said.<\/p>\n
Previously, the Advocacy Team for Democracy (TAUD)\u2014Andrie Yunus\u2019s\nlegal representatives\u2014asked the Head of Military Court 11-07 Jakarta to\nreject the case file for the acid attack on Andrie from the Military\nProsecutor 07-II Jakarta. TAUD stated that the preparation of the case\nfile was not transparent and accountable, thus not fulfilling a sense of\njustice for the victim.<\/p>\n
TAUD representative, Muhammad Isnur, said that Andrie has never\nreceived official information regarding the progress of the\ninvestigation from the Military Prosecutor or the TNI Military Police\nCentre or Puspom TNI. \u201cAndrie Yunus himself, as the victim, has\nexpressed his objection to his case being processed in a military court\nbecause it becomes a nest of impunity,\u201d said Isnur in a press statement\non Thursday, 16 April 2026.<\/p>\n
TAUD suspects that the swift transfer of Andrie Yunus\u2019s case to court\nis an effort by the TNI to protect the intellectual masterminds behind\nthe terror against Andrie, obscure facts, and avoid public pressure.\nThis is because only four perpetrators are being prosecuted. This number\nis far fewer than TAUD\u2019s findings, which suspect at least 16 field\nperpetrators involved in the incident.<\/p>\n
\u201cThis transfer further proves the effort to create impunity for TNI\nsoldiers who commit general criminal acts,\u201d said Isnur.<\/p>\n
In addition, Isnur continued, the report submitted by TAUD regarding\ntheir investigation findings to the National Police Criminal\nInvestigation Agency or Bareskrim Polri some time ago has now been\ntransferred to Metro Jaya Police. Therefore, TAUD asked the Head of\nMilitary Court 11-07 Jakarta to reject and postpone the transfer of\nAndrie\u2019s case file.<\/p>\n
