Defense of Yorrys said groundless<\/p>\n
JAKARTA (JP): Prosecutor Sukardi asked the West Jakarta
\nDistrict Court judge yesterday to ignore the defense statement of
\nTommy Sihotang, the lawyer hired by Yorrys Raweyai and the three
\nothers on trial for gambling, saying that it was completely
\ngroundless.<\/p>\n
\"Your Honor, the defense's statement claiming that my
\nindictment is inaccurate is an age-old cliche typically employed
\nto counter a prosecutor's statement,\" Sukardi said.<\/p>\n
In the previous session, Tommy asked presiding judge Ismail
\nSebayang to annul the indictment because it contained an
\ninaccurate description of the crime and because it lacked
\nadequate evidence.<\/p>\n
Tommy said on Tuesday that he disagreed with the prosecutor's
\ndecision to charge Yorrys and the three defendants with violating
\nseveral laws governing gambling.<\/p>\n
\"The fact that Yorrys was caught red-handed on July 29 at a
\ngambling den in West Jakarta was not enough to prove, or charge,
\nthat he was organizing or making a living from the games,\" Tommy
\nsaid last Tuesday.<\/p>\n
However, Sukardi said that the defendants used the gambling
\nprofits for their personal needs and that was sufficient
\nevidence.<\/p>\n
Prosecutor Sukardi, who replaced prosecutor Noor Said, stated
\nthat he will support his statement in the next court examination
\nsession.<\/p>\n
Tommy stated that the case lacked substantial evidence because
\nthe money and gambling paraphernalia were confiscated from the
\ndefendants personally and also from their premises. Sukardi said
\nthat such argumentation was legally incorrect since all evidence
\nwas seized legally.<\/p>\n
After hearing the prosecutor's statement, judge Ismail
\nadjourned the trial until Oct. 24 to decide whether or not he
\nwould accept the prosecutor Sukardi's statement.<\/p>\n
Yorrys, the day-to-day chairman of the Golkar-affiliated
\nPemuda Pancasila youth organization, is being tried along with
\nsix other defendants on charges of organizing games of chance and
\nplaying rummy and macok at a storehouse at Jl. Daan Mogot 125 in
\nWest Jakarta.<\/p>\n
Yorrys was arrested along with six other suspects, but was
\nreleased on bail shortly afterwards.<\/p>\n
The defendants are being tried in two separate trials.<\/p>\n
Yorrys is being tried along with three other alleged gamblers,
\nSundoro Tan, Budianto and Hadi Mustapa.<\/p>\n
Unlike the previous sessions, Yorrys' wife and dozens of
\nMobile Brigade officers were absent from the court room but some
\nfaithful supporters were still there.(mas)<\/p>",
