Defendant denies allegations of abusing migrant workers<\/p>\n
JAKARTA (JP): A panel of judges at the Central Jakarta
\nDistrict court laughed on Tuesday at the responses of a 49-year-
\nold defendant charged with the physical abuse and sexual
\nmolestation of two prospective female migrant workers.<\/p>\n
Prosecutor Abdul Kadir Latief told the hearing that Nasir
\nSalim, an Indonesian of Arab descent, sexually molested Yayan
\nYulianti and physically abused Iis binti Kanda in a drunken
\nstupor on March 11, 2000.<\/p>\n
\"In his drunkenness, Nasir forcibly ordered Yayan to give him
\na massage at 10:30 p.m. on March 11, during which he fondled her
\nbreasts, buttocks, thighs and genitalia,\" Latief told the
\nhearing, presided over by judge Hoepojo.<\/p>\n
\"Later that night, as witnessed by several people, he banged
\nIis' head at least twice on the floor in rage.\"<\/p>\n
At the time Yayan and Iis were living in a two-story all-
\nfemale dormitory on Jl. Percetakan Negara X, Central Jakarta,
\nowned by PT Dian Karya Trampil, a labor export firm headed by the
\ndefendant's younger sister, Patya.<\/p>\n
The victims were waiting to be sent to Saudi Arabia for work.<\/p>\n
Latief said the defendant had violated Paragraph 1 of Article
\n351 of the Criminal Code on physical abuse, which carries a
\nmaximum of two years and eight months in prison; and Article 289
\nof the Criminal Code on sexual molestation, which carries a
\nmaximum of nine-years imprisonment.<\/p>\n
Judge Hoepojo then asked the defendant if he had fondled
\nYayan's breasts.<\/p>\n
Nasir immediately replied: \"In the name of Allah and my seven
\ngenerations to come, I never touched her breasts.<\/p>\n
\"Saya orang alim pak. Saya suka sholat\" (I am a devout man,
\nsir. I often perform my prayers.)<\/p>\n
At this, the panel of judges laughed for some time, and
\nrepeatedly asking the defendant if they had heard him right and
\nthat he had used the word \"alim\" (devout).<\/p>\n
Hoepojo then asked the defendant whether he had any business
\nupon entering the dormitory.<\/p>\n
Nasir said he had been assigned to handle administrative
\nduties at his sister's firm.<\/p>\n
The judge then called on the defendant's sister, Patya, and
\ntold her to confirm what her brother had just said.<\/p>\n
\"He had no business entering the dormitory. He is not in
\ncharge of anything,\" Patya told the court.<\/p>\n
Following Patya's testimony, prosecutor Latief asked the
\ndefendant whether he was telling the truth and that he was in
\ncharge of administrative tasks, including on the day of the
\nincident.<\/p>\n
The defendant remained silent. Latief then asked him what kind
\nof work he was doing at 10:30 p.m. in the dormitory.<\/p>\n
Again, Nasir remained silent.<\/p>\n
Earlier in the hearing, Latief said that Yayan had asked the
\ndefendant's permission to pray to stop her molestation. The
\ndefendant agreed to her request but told her to return
\nafterwards.<\/p>\n
\"When Yayan did not return, the defendant went up to the
\nsecond floor and started asking for another girl, while verbally
\nabusing, kicking and pulling Iis' hair, who was sleeping on the
\nsecond floor,\" Latief told the court.<\/p>\n
He said that the Iis tried to run down the stairs to escape,
\nbut fell over and started to bleed from her mouth.<\/p>\n
\"Instead of helping the wounded girl, the defendant, in front
\nof several eyewitnesses, banged Iis' head on the floor at least
\ntwice, while screaming for her to get up. Iis immediately started
\nbleeding from her head and fainted.\" (ylt)<\/p>",
