Jakarta (ANTARA) - The Indonesian Curators and Administrators\nAssociation (PERKAPI) is urging the House of Representatives (DPR RI) to\nprioritise the Draft Law on the Curator Profession, as the profession\nstill lacks a legal umbrella that specifically governs professional\nstandards, recruitment, competence and oversight.<\/p>\n
Speaking at a joint meeting with DPR Commission XIII in Jakarta on\nTuesday, PERKAPI Advisory Board member Asri Munde said specific\nregulations are needed to avoid a vacuum or overlapping arrangements\nwith Law Number 37 of 2004 on Bankruptcy and Suspension of Debt Payment\nObligations (PKPU).<\/p>\n
\u201cBecause recruitment procedures, competence and so on are indeed not\nyet regulated. So we propose that this would best be made a priority law\nand serve as \u2018lex specialis\u2019,\u201d said Asri.<\/p>\n
Lex specialis is a Latin legal term meaning a law or regulation of a\nspecific nature.<\/p>\n
According to him, the urgency of forming such a regulation is all the\ngreater because the curator profession has existed since 1998, yet to\nthis day there is no law that specifically oversees it.<\/p>\n
\u201cCurators have been around since \u201998, but there has never been an\norganisation or law covering them. Everything is based on Government\nRegulations or regulations from the Minister of Law and Human Rights,\u201d\nhe said.<\/p>\n
PERKAPI is also open to the formation of a single joint umbrella for\ncurator professional organisations, particularly to draw up a shared\ncode of ethics, professional standards and oversight standards.<\/p>\n
\u201cIn the discussions we have had, we have no objection to there being\none umbrella that can cover all these organisations, particularly\nregarding a code of ethics and shared standards, shared oversight\nstandards,\u201d he said.<\/p>\n
Meanwhile, Chair of DPR Commission XIII Willy Aditya said the Draft\nLaw on the Curator Profession has been designated a DPR initiative bill\nand included in the annual Priority National Legislation Programme\n(Prolegnas).<\/p>\n
