We are witnessing an increasing number of robberies of bank
\nclients, murders of taxi drivers and eviction of powerless people
\nfrom their homes, not to mention the torture of suspects during
\ninvestigations.<\/p>\n
In fact the Criminal Administration Code clearly stipulates
\nprocedure in all areas from the investigation process to the
\nprosecution. The Code also regulates a suspect's rights that have
\nto be observed by the investigating team, prosecutors and judges
\nin the quest to uphold the law.<\/p>\n
However, in practice, investigators often ignore suspects'
\nrights, so that it is often the case that during a trial
\ndefendants withdraw their statements already written in the
\ninvestigation report. This only shows the weakness of the
\nCriminal Administration Code. The weakness may result from an
\nabsence of sanctions for investigators who violate the code.<\/p>\n
I am deeply concerned over the prevailing recent situations.
\nWhether or not torture is used during investigations, we should
\nnot blame anybody. The most important thing now is that the
\nCriminal Administration Code, particularly those articles
\nconcerning the investigation process, should be revised.<\/p>\n
