        "content": "<p>The circulation of counterfeit products in Indonesia has once again\ndrawn attention after the Commercial Court at the Central Jakarta\nDistrict Court ruled on a trademark infringement case related to the\nsale of counterfeit Timken-branded bearings.<\/p>\n<p>The ruling affirms that the illegal distribution of branded products\ncan lead to legal consequences while also causing losses for consumers\nand business actors who operate lawfully.<\/p>\n<p>In Decision Number 133\/Pdt.Sus-HKI\/Merek\/2025\/PN Niaga, handed down\non 9 April 2026 and now legally binding, the Central Jakarta District\nCourt declared that The Timken Company had successfully proven the sale\nof counterfeit Timken-branded bearings in violation of Article 83\nparagraph (1) of Law Number 20 of 2016 on Trademarks and Geographical\nIndications.<\/p>\n<p>The court also ordered the party found to have committed the\ninfringement to pay compensation of Rp94.61 million to Timken and to\ncease all activities related to the sale of counterfeit Timken-branded\nbearing products.<\/p>\n<p>The ruling serves as a reminder that the issue of counterfeit\nproducts is not merely a violation of intellectual property rights, but\nalso relates to consumer protection, business certainty, and the\nsustainability of a healthy market.<\/p>\n<p>The presence of counterfeit products has the potential to cause\nlayered losses. Consumers may obtain products of unguaranteed quality,\nwhile legitimate business actors must face competition from parties who\ndo not adhere to the same business standards and obligations.<\/p>\n<p>Ardhiyasa SH, Managing Partner of A&amp;Co Law Office and legal\ncounsel for The Timken Company, said the ruling is part of the company\u2019s\ncommitment to stopping the circulation of counterfeit bearing products\nin Indonesia.<\/p>\n<p>\u201cThis ruling is one effort to demonstrate Timken\u2019s commitment to\nstopping and eradicating the circulation of counterfeit Timken-branded\nbearing products in Indonesia and to protecting customers, business\npartners, and consumers,\u201d said Ardhiyasa.<\/p>\n<p>According to him, efforts to eradicate counterfeit products require\nattention not only from brand owners and law enforcement officials, but\nalso from consumers and business actors as part of the distribution\nchain.<\/p>\n<p>Timken also urged end-users and business actors in related fields to\nincrease their vigilance against counterfeit bearing products or other\nproducts bearing the Timken brand that circulate through unauthorised\nparties.<\/p>\n<p>Consumers and business actors are asked to purchase Timken-branded\nbearings through official distributors and to verify the identity of\nsellers or suppliers through Timken\u2019s official website.<\/p>\n<p>If members of the public discover suspected circulation of\ncounterfeit products, they are also urged to report it immediately to\nTimken\u2019s official distributor in Indonesia with supporting evidence.<\/p>\n<p>This step is important to narrow the space for the circulation of\ncounterfeit goods while helping brand owners and related parties take\naction against products suspected of violating regulations.<\/p>\n<p>This case also demonstrates the importance of collaboration between\nbrand owners, business actors, consumers, and law enforcement officials\nin maintaining the integrity of the Indonesian market.<\/p>\n<p>Strengthening supervision of counterfeit goods is becoming\nincreasingly important as distribution and trade networks expand,\nallowing products to circulate through various channels.<\/p>\n<p>The Ministry of Law, through the Directorate General of Intellectual\nProperty, destroyed 567 products using the Lacoste brand without\nauthorisation.<\/p>\n<p>The Directorate General of Intellectual Property and Customs and\nExcise emphasised the importance of trademark recordation to prevent\ncounterfeit goods from entering Indonesia. Brand owners are urged to be\nproactive in protecting their intellectual property rights.<\/p>",
