Council to probe Kemayoran land row<\/p>\n
JAKARTA (JP): A 20-member group sought the City Council's help
\nyesterday over a land dispute with two private developer
\ncompanies, PT Sinar Mas Group and PT Duta Pertiwi.<\/p>\n
At stake, according to the group, is a 19.62-hectare plot on
\nJl. Let. Jen. Suprapto in Kemayoran, Central Jakarta.<\/p>\n
The 27-story Cempaka Mas apartment block and a 4-story office
\nbuilding have been constructed on the plot in a joint venture
\nbetween the two companies.<\/p>\n
A member of the group, Pieter Tarigan, which represents PT
\nRaya Ahman, a private firm, asked the council to intervene and
\nsettle the problem.<\/p>\n
The land belongs to Raya Ahman, which has been awarded a deed
\nof lease as stipulated in the Jakarta High Court decree number
\n212 issued in 1983, Pieter said.<\/p>\n
The firm bought the land from farmers in early 1974 but later
\nlearned that it belonged to the state. As compensation, Raya
\nAhman received lease rights from the court, he said.<\/p>\n
But Pieter had no idea how long Raya Ahman had the rights to
\nlease the land.<\/p>\n
In 1992 construction on the plot began and it was converted
\ninto an apartment and office building without the knowledge of
\nRaya Ahman, he said.<\/p>\n
\"We are confused. We can't do anything else but go to the city
\ncouncilors for help.\"<\/p>\n
He insisted that Raya Ahman was the legitimate owner of the
\nland because they held the land titles and had been paying
\nproperty tax every year.<\/p>\n
When asked why the group had submitted its complaint to City
\nCouncil so late, Pieter explained that Raya Ahman's director,
\nTony K. Damanik, had only learned that the land was occupied in
\n1995, when he returned from living abroad for 15 years.<\/p>\n
\"Tony was shocked to find the land had been converted into
\napartments and immediately reported the matter to the Central
\nJakarta Mayoralty, district and subdistrict offices of
\nKemayoran,\" he said.<\/p>\n
\"But they say that the land is state property, so if we have a
\nproblem, they said we needed to settle it with the State
\nSecretary's office.\"<\/p>\n
Joice Budisusanto, spokeswoman for PT Duta Pertiwi, told The
\nJakarta Post that her company never realized there was a problem
\nwith the status of the Cempaka Mas land.<\/p>\n
\"Our company got the land from PT Mercu Buana, which is owned
\nby Pak Probosutedjo,\" she said. \"The latter got the land titles
\nfrom the State Secretary's office about five years ago.\"<\/p>\n
She expressed concern over the land issue.<\/p>\n
\"We were never informed by PT Raya Ahman about this,\" she
\nsaid. \"If they had come to us sooner, instead of visiting the
\nCity Council, we may have settled the problem fairly.<\/p>\n
\"We are open to discussion with the related parties. But,
\nsincerely, we had no idea that there were problems with the plot.
\nWe will investigate the matter.\"<\/p>\n
She said that her company would not have developed the
\napartment project if it had no legal land documents.<\/p>\n
Representatives of PT Raya Achman were received yesterday by
\nCommission A for administrative affairs.<\/p>\n
The councilors promised to discuss the problem with related
\nparties and arrange a hearing with all the companies involved.<\/p>\n
\"We'll try to arrange a meeting to solve this matter
\nproperly,\" councilor Saamin, the head of the commission, said.
