Jakarta (ANTARA) \u2013 Coordinating Minister for Political, Legal and\nSecurity Affairs Yusril Ihza Mahendra has reiterated that the acquittal\nof Lokataru Foundation Executive Director Delpedro Marhaen and his\nco-defendants is final.<\/p>\n
\u2018So it cannot be appealed any further because it ends here, and no\nfurther legal avenues can be pursued,\u2019 the Coordinating Minister said in\na video briefing confirmed in Jakarta on Saturday.<\/p>\n
He explained that under Article 299 of the new Criminal Procedure\nCode (KUHAP), an acquittal or a discharge cannot be subject to any\nappeal by the public prosecutor, including filing a cassation to the\nSupreme Court (MA).<\/p>\n
He noted that under the old KUHAP, this was actually already\nregulated, but in practice prosecutors created a theory that acquittals\nwere divided into two types: pure acquittal and non-pure acquittal. If\nthe acquittal is not pure, he said, then prosecutors could file a\ncassation. However, what is problematic, he noted, is that the criteria\nfor whether an acquittal is pure or not has not been very clear.<\/p>\n
\u2018Such practices cause a great deal of confusion in law enforcement,\u2019\nhe said.<\/p>\n
In addition to Delpedro, three other defendants were acquitted:\nLokataru staff Muzaffar Salim; Gejayan Memanggil administrator Syahdan\nHusein; and Aliansi Mahasiswa Penggugat administrator Khariq Anhar.<\/p>\n
The four defendants were acquitted after it was determined they were\nnot proven guilty of committing offenses in the case of alleged\nincitement during the August 2025 demonstrations that ended in\nclashes.<\/p>\n
In the trial, prosecutors were deemed unable to present evidence\nshowing attempts to manipulate, fabricate, or engineer facts by the\ndefendants.<\/p>\n
Thus, the panel of judges ordered the public prosecutors to restore\nthe rights of the defendants in their capacity, status, dignity and\nhonour.<\/p>\n
Earlier, the four defendants were charged with two years\u2019\nimprisonment after being believed beyond reasonable doubt to be guilty\nof an offense, namely participating in a crime in public with oral or\nwritten statements urging people to commit crimes, or inciting people to\noppose the authorities with violence.<\/p>\n
In that case, Delpedro and colleagues were charged with uploading 80\ncollaborative contents that were inciting and aimed at stirring hatred\nagainst the government from 24-29 August 2025.<\/p>\n
It was stated that the defendants uploaded electronic information on\nsocial media managed by the four defendants, which invited students to\nparticipate in rioting.<\/p>\n
The appeals on social media were produced from 24-29 August 2025,\nwhere the narratives posted by the defendants allegedly indoctrinated\nstudents, mostly underage, to participate in anarchy in front of the DPR\nRI, in front of Polda Metro Jaya, and at several other locations.<\/p>\n
One of the postings that formed the basis of the indictment was a\nposter titled \u2018Legal aid for students joining the street protests\u2019 with\nthe caption \u2018You students who join the actions?
