        "content": "<p>Jakarta, CNBC Indonesia \u2014 The Financial Services Authority (OJK) has\nemphasised that paylater providers are responsible for fulfilling all\nconsumer protection provisions.<\/p>\n<p>This means that paylater providers must ensure product suitability\nwith the needs and capabilities of potential consumers, provide clear,\naccurate, honest, accessible, and non-misleading information, and ensure\nthat potential consumers understand the benefits, costs, risks, as well\nas their rights and obligations.<\/p>\n<p>On the other hand, consumers also need to read and understand product\ninformation and consider their ability to pay before making a decision.\nHowever, consumer consent does not eliminate the obligation and\nresponsibility of Financial Service Business Actors (PUJK) to fulfil all\nconsumer protection provisions.<\/p>\n<p>The Chief Executive of Supervision of Financial Service Business\nConduct, Education, and Consumer Protection, Dicky Kartikoyono, stated\nthat if losses occur due to errors, negligence, or acts that violate\nregulations by management, employees, or third parties working for the\ninterest of the financial service business actor (PUJK), the PUJK\nremains responsible to the consumer, in accordance with Article 10 of\nOJK Regulation (POJK) Number 22 of 2023.<\/p>\n<p>\u201cConsumer consent does not eliminate the obligation and\nresponsibility of the PUJK to fulfil all consumer protection\nprovisions,\u201d said Dicky in a written response, as quoted on Wednesday\n(15\/09\/2026).<\/p>\n<p>This is more clearly regulated in POJK Number 2ly 2023 concerning the\nProtection of Consumers and the Public in the Financial Services Sector.\nIn that regulation, PUJK are required to consider the suitability\nbetween the products or services offered and the needs and capabilities\nof potential consumers.<\/p>\n<p>This assessment is conducted by considering consumer classification,\nincluding background, occupation, financial condition, purpose of\nproduct use, and other relevant information. PUJK are also required to\ndocument the results of such assessments.<\/p>\n<p>This provision is crucial in the provision of paylater facilities,\nespecially when consumers feel from the outset that they do not have the\nability to meet their payment obligations.<\/p>\n<p>Based on these regulations, a consumer\u2019s inability to pay instalments\ndoes not automatically prove that the PUJK has violated the rules. It\nmust be examined whether the company has conducted an adequate\nassessment of the consumer\u2019s capability and whether there were errors or\nnegligence that caused the loss.<\/p>\n<p>POJK 22\/2023 also stipulates that PUJK are responsible for consumer\nlosses arising from errors, negligence, or acts contrary to statutory\nregulations or agreements, committed by management, employees, or third\nparties working for the PUJK.<\/p>\n<p>Consequently, consumers may file complaints and request explanations\nor accountability if they deem the paylater provision process to be\ninconsistent with consumer protection provisions. To claim compensation,\nthere must be a basis that the loss is related to the error or\nnegligence of the PUJK.<\/p>\n<p>However, the regulation does not state that paylater debt\nautomatically transfers to the company\u2019s responsibility or is\nimmediately declared settled if the consumer is unable to pay.<\/p>",
