        "content": "<p>Jakarta, VIVA \u2013 The Constitutional Court (MK) has decided that only\nthe Financial Audit Board (BPK) has the authority to calculate the\namount of state financial losses.<\/p>\n<p>This is stipulated in the Constitutional Court decision Number\n28\/PUU-XXIV\/2026, which was decided by the MK on Monday, 9 February\n2026. The decision was made by nine constitutional judges: Suhartoyo as\nchairman\u517cmember, Saldi Isra, Daniel Yusmic P Foekh, M Guntur Hamzah,\nAnwar Usman, Enny Nurbaningsih, Ridwan Mansyur, Arsul Sani, and Adies\nKadir, each as members.<\/p>\n<p>The petition was filed by two students named Bernita Matondang and\nVendy Stiawan. In their petition, the petitioners stated there was\nambiguity in Article 603 of the Criminal Code regarding the state\nfinancial audit institution, the examination mechanism, and the\nstandards for assessing state financial losses.<\/p>\n<p>Regarding this matter, the Corruption Eradication Commission (KPK)\nhas spoken out. KPK spokesperson Budi Prasetyo said that they respect\nand comply with the decision.<\/p>\n<p>\u201cThe KPK certainly respects and complies with the Constitutional\nCourt decision that examined Articles 603 and 604 of Law Number 1 of\n2023 on the Criminal Code, namely regarding the calculation of state\nfinancial losses,\u201d Budi said to reporters on Monday, 6 April 2026.<\/p>\n<p>\u201cIn that decision, the MK provided an interpretation that the\ninstitution authorised to calculate state financial losses is the\nFinancial Audit Board or BPK,\u201d he continued.<\/p>\n<p>Budi explained that the KPK will study the decision and its impact on\ncalculating state losses in a case.<\/p>\n<p>\u201cOf course, the KPK will study how the impact or effect is on the\nKPK\u2019s forensic accounting function, which previously also had the\nauthority to calculate state financial losses, whether with this\ndecision it can still carry out and have the authority to calculate\nstate financial losses or not,\u201d he stated.<\/p>\n<p>From previous experience, the KPK is known to have collaborated\nextensively with other institutions besides the BPK to calculate state\nlosses.<\/p>\n<p>\u201cWell, that will still be studied further, and of course, the KPK\nwill also intensively continue to coordinate with the BPK, because\npreviously the KPK has been greatly assisted by the BPK in calculating\nstate financial losses in several case investigations.
