        "content": "<p>Jakarta \u2014 Constitutional Court judge Enny Nurbaningsih raised\nquestions about whether Indonesia\u2019s current capital is Jakarta or\nNusantara (IKN) during questioning of a parliamentary representative on\n11 March 2026.<\/p>\n<p>Enny posed the question to Rudianto Lallo, a member of Commission III\nof the House of Representatives, who was representing parliament in case\nnumber 38\/PUU-XXIV\/2026, which challenges Article II of Law number 151\nof 2024 on amendments to Law number 2 of 2024 regarding the Special\nRegion of Jakarta Province (DKJ Law).<\/p>\n<p>\u201cWhere exactly should the position of the capital be?\u201d Enny asked\nduring the hearing, according to a Youtube broadcast of the\nConstitutional Court on 12 March 2026.<\/p>\n<p>The issue stems from the fact that Law 20\/2007 establishes Jakarta\u2019s\nstatus as a special provincial government and Indonesia\u2019s national\ncapital.<\/p>\n<p>\u201cGiven the enactment of Law 151\/2024, what needs clarification from\nMr Rudianto Lallo is that this law has changed or even repealed Law\n29\/2007 on the governance of Jakarta Special Province, which established\nit as the capital \u2014 that repeal has already taken effect,\u201d Enny stated\nfirmly.<\/p>\n<p>However, the presidential decree that would establish Jakarta as a\nspecial region and remove its status as the national capital has not yet\nbeen signed by the President.<\/p>\n<p>Meanwhile, Jakarta\u2019s status as the national capital in Law 29\/2007\nhas already been revoked with the enactment of Law 151\/2024.<\/p>\n<p>\u201cThis needs clarification, Sir, regarding the timeline to ensure the\nlegal position of the capital is clear. Since the law establishing\nJakarta as the capital has been repealed, whilst the presidential decree\nhas not yet been issued,\u201d Enny said.<\/p>\n<p>\u201cNow it is called DKJ, so where exactly is the position of the\nnational capital? We request additional clarification on this matter,\u201d\nshe added.<\/p>\n<p>The case number 38\/PUU-XXIV\/2026 was filed by Astro Alfa Liecharlie,\nwho challenges Article II of the DKJ Law.<\/p>\n<p>Article II of the DKJ Law states: \u201cThe Presidential Decree regarding\nthe relocation of the Capital of the Republic of Indonesia from Jakarta\nSpecial Region to Nusantara is to be determined later.\u201d The word \u201clater\u201d\nin this article is considered ambiguous and does not provide clear time\nlimits regarding the determination of capital relocation.<\/p>",
