        "content": "<p>Chairman of the Central Executive Board of the Indonesian Empowered\nPeople Civil Society Organisation (LSM Rakyat Indonesia Berdaya), Hitler\nSitumorang, through the Analysis, Investigation &amp; Advocacy Division\nteam, delivered by its analyst Harno Pangestoe, has issued sharp\ncriticism against the procurement project for the Maintenance of the\nIntegrated Electronic Business Licensing System (OSS) for the 2026\nFiscal Year, implemented by the Ministry of Investment and\nDownstreaming\/BKPM (Investment Coordinating Board). The project, valued\nat Rp30,658,331,000, is deemed to contain several serious irregularities\nthat potentially violate government procurement principles and open the\ndoor to unhealthy practices in state budget management. In the official\ndocuments, the method used is Direct Appointment with only one\nparticipant, namely PT Telekomunikasi Indonesia Tbk. This condition is\nseen as contrary to the basic procurement principles as regulated in\nPresidential Regulation Number 16 of 2018 and its amendments in\nPresidential Regulation Number 12 of 2021, which emphasise efficient,\neffective, transparent, open, competitive, fair, and accountable\nprinciples. \u201cHow can the principle of healthy competition be fulfilled\nif there is only one participant? This is not procurement; this is a\nclosed appointment that potentially locks the market,\u201d Harno asserted\nfirmly. The Estimated Own Price (HPS) is recorded at Rp30,655,610,370,\nwhile the submitted offer is Rp30,655,415,898, with a difference of only\naround Rp194 million or 0.0006 percent. After negotiation, the value\nonly drops to Rp30,651,601,938, or less than 0.02 percent. This\nsituation is viewed as strong evidence of a lack of healthy price\ncompetition and raises suspicions of HPS leakage or offer value\nconditioning. \u201cIn healthy procurement practices, such differences are\nalmost impossible without access to internal information. This should be\nsuspected as a form of conditioning,\u201d Harno stated. This package is a\nrepeat order for the Online Single Submission (OSS) system, which is a\nnational strategic system and the main gateway for all business\nlicensing services in Indonesia. This is dangerous for national digital system\nsovereignty,\u201d he emphasised. In addition, the technical specifications\nin the qualification documents are deemed too complex and highly\ndetailed, requiring dozens of experts from various fields, from backend,\nfrontend, QA, to project management and data. This condition is seen as\npotentially leading to technical conditioning that can only be met by a\nspecific party. \u201cThis is a classic pattern of procurement conditioning,\nwhere specifications are crafted in such a way that only one party meets\nthem,\u201d Harno revealed. Based on the analysis results, there is potential\nviolation of government procurement principles, indications of unhealthy\nbusiness competition, and potential waste of state budget. Therefore,\nLSM RIB states it will bring these findings to the Corruption\nEradication Commission, Financial Audit Board, Attorney General\u2019s Office\nof the Republic of Indonesia, Indonesian National Police, and the\nGovernment Goods\/Services Procurement Policy Agency as a form of\noversight and prevention. \u201cWe see this not merely as ordinary\nprocurement, but a systemic pattern that recurs in government technology\nprojects. If not stopped, this will become a field for continuous state\nbudget waste,\u201d Harno said. LSM Rakyat Indonesia Berdaya urges a\ncomprehensive audit, transparent opening of the system architecture, and\nthe implementation of competitive and accountable procurement mechanisms\nfor national strategic projects.
