        "content": "<p>City loses case on private markets<\/p>\n<p>The Jakarta government lost a case filed by property and retail<br>\nbusinesses with the State Administrative Court over its<br>\ngubernatorial decree on privately owned markets.<\/p>\n<p>The court ruling was made public by officials from the city<br>\nadministration&apos;s legal bureau on Friday.<\/p>\n<p>In its ruling dated April 21, the court ordered the governor<br>\nto revoke the decree.<\/p>\n<p>Decree No. 44\/2003 stipulates that the managements of<br>\nprivately owned markets have to allocate 20 percent of their<br>\nfloor space for small and medium enterprises (SMEs), instead of<br>\npaying monetary compensation as provided for in the 2002 Bylaw on<br>\nprivately owned markets.<\/p>\n<p>Many people, including the councillors, argued that this 2002<br>\nstipulation opened the door to corruption, as much of the money<br>\ndid not in fact go to the SMEs.<\/p>\n<p>However, the Association of Indonesian Real Estate Companies<br>\n(REI), the Association of Indonesian Retailers and the<br>\nAssociation of Indonesian Shopping Center Managements objected to<br>\nthe decree, which they said could scare investors away and<br>\ninfringed on their right to manage their own properties.<\/p>\n<p>Councillor Syarif Zulkarnaen, the chairman of the City<br>\nCouncil&apos;s economics commission, suspected something untoward was<br>\nafoot.<\/p>\n<p>&quot;After the revocation of this decree, the officials will be<br>\nable to gain illicit benefit once again from the monetary<br>\ncompensation payments,&quot; he said after meeting with officials from<br>\nthe legal bureau. --JP<\/p>",
