City loses case on private markets<\/p>\n
The Jakarta government lost a case filed by property and retail
\nbusinesses with the State Administrative Court over its
\ngubernatorial decree on privately owned markets.<\/p>\n
The court ruling was made public by officials from the city
\nadministration's legal bureau on Friday.<\/p>\n
In its ruling dated April 21, the court ordered the governor
\nto revoke the decree.<\/p>\n
Decree No. 44\/2003 stipulates that the managements of
\nprivately owned markets have to allocate 20 percent of their
\nfloor space for small and medium enterprises (SMEs), instead of
\npaying monetary compensation as provided for in the 2002 Bylaw on
\nprivately owned markets.<\/p>\n
Many people, including the councillors, argued that this 2002
\nstipulation opened the door to corruption, as much of the money
\ndid not in fact go to the SMEs.<\/p>\n
However, the Association of Indonesian Real Estate Companies
\n(REI), the Association of Indonesian Retailers and the
\nAssociation of Indonesian Shopping Center Managements objected to
\nthe decree, which they said could scare investors away and
\ninfringed on their right to manage their own properties.<\/p>\n
Councillor Syarif Zulkarnaen, the chairman of the City
\nCouncil's economics commission, suspected something untoward was
\nafoot.<\/p>\n
"After the revocation of this decree, the officials will be
\nable to gain illicit benefit once again from the monetary
\ncompensation payments," he said after meeting with officials from
\nthe legal bureau. --JP<\/p>",
